Wage Indexation During Russian Personal Bankruptcy: Increases and Back Pay

Wage indexation during Russian personal bankruptcy raises two related questions: how much the employer must accrue and how much the employee may use during the proceedings. This guide separates current indexation, back pay for earlier months and documents for the financial manager.

This material concerns an employee’s personal court bankruptcy, particularly asset realisation. It does not cover employer insolvency or indexation of an amount already awarded by a court. Legal provisions checked on 7 September 2026.

A new salary amount

The employment guarantee remains. Personal bankruptcy is not, by itself, a reason to exclude an employee from wage indexation.

Back pay

A monthly breakdown is needed. A bank transfer labelled indexation is insufficient to calculate the protected portion.

Evidence before labels

Check the indexation rules, employer order, payslip and protected funds already released. The entire increase is not automatically retained.

What the employer must do

Article 134 of the Russian Labour Code provides for wage indexation in response to rising consumer prices. For state bodies, local government bodies and state or municipal institutions, the procedure is governed by employment legislation and relevant regulations. Other employers follow procedures established by collective agreements, other applicable agreements and local employment regulations.

This provision does not set one compulsory percentage or date for every private company. A specific calculation requires the employer’s rules: which pay components are indexed, from what date, how frequently and using which measure. The employee’s bankruptcy does not replace those rules.

No written procedure does not mean no right. In Supreme Court Ruling No. 89-KG18-14 of 8 April 2019, the court explained that an employer cannot remove the guarantee simply by failing to establish an indexation procedure. It also required an examination of whether salary increases and bonuses actually implemented indexation. The refusal of the claim was overturned and the case remitted: this was not a final award of the entire amount claimed, nor a ruling on protection of money in bankruptcy.

Who receives the increase during asset realisation?

Under Article 213.25 of the Bankruptcy Law, receipts are assessed against the bankruptcy estate rules and statutory exclusions. Protection of necessary funds is linked, among other provisions, to Article 446 of the Civil Procedure Code. The indexed part of salary does not acquire separate full immunity merely because it offsets rising prices.

A salary increase therefore does not automatically increase the amount the employee may keep. First identify the applicable protected amount, the period, other receipts and money already released. When back pay covers several months, do not simply multiply today’s subsistence minimum by their number. Reconstruct the calculation for each period, checking amounts already received, protected funds and any grounds for further exclusion. A disputed amount does not become freely available just because the employee submits an application.

Illustrative indexation calculation

Suppose a particular employer’s local rules set a coefficient of 1.05 for a RUB 40,000 base salary from a specified month. The new base salary for a fully worked month is RUB 40,000 × 1.05 = RUB 42,000. If only the previous RUB 40,000 was accrued for that month, the difference is RUB 2,000.

This calculation concerns accruals before personal income tax and other lawful deductions, not the amount the financial manager must release to the employee. The 1.05 coefficient is an assumption, not an actual inflation figure or a universal rate for employers. Payroll first determines the amount payable; the amount accessible in bankruptcy is then assessed separately. Recalculating bonuses, holiday pay or other components requires examination of their own rules and is outside this example.

Five steps if indexation was not accrued

  1. Collect the pay rules. Obtain the employment contract and amendments, relevant collective agreement provisions, other applicable agreements and local indexation regulations.
  2. Compare the rules with actual accruals. Ask payroll to explain the indexation measure, date and pay components covered. Distinguish indexation from performance bonuses.
  3. Prepare a monthly calculation. Show actual accruals, the amount due under the applicable procedure, the difference and the amount payable. Attach payslips.
  4. Tell the financial manager about the claim. Provide documents and details of protected funds for the relevant periods. Do not conceal or abandon the claim to bypass the bankruptcy estate.
  5. Do not delay protecting your rights. If the dispute remains unresolved, check the court filing deadline and participation in the employment case. Bankruptcy does not make it safe to wait until the proceedings end.

Labour Code Article 392 allows one year from the prescribed payment date for disputes over unpaid or underpaid wages and other amounts due to an employee. For a specific indexation claim, check its nature and when the obligation fell due; a court may restore a missed deadline for valid reasons. Frequently asked questions

Can only the bankrupt employee be excluded from indexation?

Bankruptcy alone does not cancel employment guarantees. Eligibility for indexation follows the law and applicable pay rules, not the existence of the employee’s debts.

Does any bonus replace indexation?

No automatic substitution applies. Review the local documents and the payment’s purpose. A performance bonus and a mechanism for maintaining the real value of wages can have different legal bases.

Will I keep all back pay for earlier years?

Not automatically. A period-by-period calculation, details of money already received and applicable exclusions are needed. The employment debt recovered and the amount excluded from the bankruptcy estate are separate questions.

Are wage indexation and late-payment compensation the same?

No. Indexation maintains the real value of wages under Labour Code Article 134; compensation under Article 236 concerns a missed payment deadline. Keep their grounds and calculations separate even if the employer transfers them together.
