Sources for this calculation

What the calculator measures. This is the amount that may be excluded from the bankruptcy estate when income is received in the relevant month. If income is lower than the protected threshold, the debtor keeps the amount actually received; the insolvency manager does not pay the difference.

What may be retained above the calculated amount

The calculator shows a baseline based on the subsistence minimum. This is not always the final amount: certain payments are protected directly by law, while additional necessary expenses may be exclude. The purpose of each payment must be documented and kept separate from ordinary income.

Article 101 of Federal Law No. 229-FZ · paragraph 1 of Supreme Court Plenum Resolution No. 48

May be excluded by the court

The court may additionally exclude reasonable and documented expenses necessary for the normal life of the debtor and family. Rent is a recognised example; the decision depends on the facts, the amount claimed and the balance between debtor and creditor interests.

Article 213.25(2) of the Russian Bankruptcy Law · paragraph 32 of the Supreme Court Review dated 18 June 2025

An individual review is necessary. The type and purpose of a payment, supporting documents and actual expenses may change the result. Review the calculation with a specialist before applying to the insolvency manager or the court.

How to obtain the protected amount

    1

    Document the income

Bank statements, employer certificates and pension records.

    2

    Document the family

Birth certificates and evidence of dependency.

    3

    Apply to the insolvency manager

Submit an application to exclude the monthly amount.

    4

    Resolve a dispute

If refused, apply to the Russian commercial court handling the bankruptcy.

    Frequently asked questions

How much money is retained for living expenses in Russian bankruptcy?

The calculation starts with income actually received. The debtor retains the applicable subsistence minimum and, for each documented minor dependant, the child subsistence minimum. If income is lower than the protected threshold, the financial administrator does not pay the difference; protected-purpose payments and additional necessary expenses are considered separately.

Is money paid if no income was received that month?

No. The Russian Supreme Court has explained that the subsistence amount is excluded only from funds actually received by the debtor or the estate in that month. It does not accrue as a debt owed by the insolvency manager.

Is a full subsistence minimum always retained for every child?

The child must actually be dependent on the debtor. The current approach uses the full child subsistence minimum for each child dependent on the debtor. Dependency and family composition must be documented; the other parent’s participation does not automatically reduce the amount by half.

Are child support and child benefits included in the bankruptcy estate?

Purpose-specific payments protected from enforcement are treated separately. Keep them separate from ordinary salary or pension and retain documents showing the payment purpose.

Can a debtor retain more than the subsistence minimum in bankruptcy?

Yes. Purpose-specific payments protected by law are treated separately when their purpose is documented. The court may also exclude additional necessary and reasonable expenses, such as documented rent. This is not automatic: evidence and an individual legal position are required.

Does the calculation omit important expenses?

A paid initial consultation can be used to review the documents, identify evidence of dependency and prepare a position for the insolvency manager or court.
