EMPLOYMENT DISPUTES AND PERSONAL BANKRUPTCY
Average earnings awarded for a period of unlawful dismissal do not become fully protected social benefits merely because they are called compensation. During asset realisation, disclose the award and separately substantiate funds that should remain available to the individual. A breakdown is especially important when a lengthy period is paid in one transfer.

What is pay for forced absence?
Article 394 of the Russian Labour Code provides for reinstatement following unlawful dismissal or transfer, with average earnings for forced absence or the earnings difference for lower-paid work. The court may also award compensation for non-pecuniary harm at the employee’s request.
This guide addresses a case where the employee personally is bankrupt. It does not cover payment priorities in an employer’s insolvency. Nor is the award ordinary wages for a month actually worked: its basis and period are established by the judgment.
Why a judgment does not mean you can keep the whole award
Article 213.25 of the Bankruptcy Law governs an individual’s property and proprietary rights during asset realisation. Notify the financial manager of the monetary award before the transfer arrives. Being named as recipient in the writ does not determine the amount excluded from the estate.
Protection of essential funds is assessed under Article 446 of the Civil Procedure Code and paragraphs 1–2 of Supreme Court Plenum Resolution No. 48. Disagreements are resolved by the court handling the bankruptcy. This assessment is distinct from the employment proceedings establishing the employer’s debt.
Neither keeping the entire award nor retaining only one subsistence minimum for the whole payment can be promised in advance. For earlier months, the relevant periods, other funds received and exclusions already made matter. Multiplying today’s subsistence minimum by the number of months is not a substitute for substantiation.

Each component needs its own assessment. The table does not automatically include or exclude damages and costs: it helps preserve distinctions in the paperwork.
Five steps after a monetary award
- Collect the court documents. Obtain the judgment, subsequent decisions changing the amount, the enforcement document and calculation. Mark sums already paid to avoid claiming them twice.
- Prepare a timeline. Include dismissal, forced absence, commencement of bankruptcy stages, the judgment and transfer dates. This helps identify issues requiring separate review.
- Reconcile receipts. Prepare bank statements and income information for the disputed months, plus records of funds previously retained for living expenses. Attach evidence of dependants or exceptional essential expenses where relevant.
- Write to the manager. Disclose the claim and propose separate recording of its components. State the amount requested for exclusion and the reasons, attach the calculation and ask how payment should be received.
- Record disagreements. If the request is rejected or the calculation disputed, retain correspondence and prepare an application to the arbitrazh court within the bankruptcy case. Do not spend the disputed balance solely on the strength of your own calculation.
If employment proceedings have not started
Do not delay checking the deadline while awaiting a bankruptcy decision. Article 392 of the Labour Code sets a one-month time limit for dismissal disputes, linked to receipt of the dismissal order copy, employment record book or employment activity information. The one-year limit for unpaid-wage claims does not replace the dismissal challenge deadline. A court may restore a missed deadline for valid reasons, but this should not be assumed.

Illustrative example without an automatic formula
An employee is awarded average earnings for several months and separate non-pecuniary damages. The employer sends both in one payment. For the financial manager, the individual prepares the judgment’s breakdown, the earnings periods and statements. There were other receipts in some months but none in others. The request to retain funds is therefore supported by the circumstances, rather than dividing the transfer into equal parts or declaring the entire sum protected.
Frequently asked questions
Should I tell the manager before the money arrives?
Yes. Disclose the monetary award before receipt and provide the documents. After payment, add the bank statement and calculation of the amount actually received.
The transfer says only “under a court judgment”. Is that enough?
A breakdown is preferable for separate recording. Match the payment to the judgment and ask payroll for the amounts accrued, deductions and periods covered.
Can I ask for payment to a relative?
Do not use another person’s account to hide a receipt or bypass bankruptcy rules. Agree a lawful payment process with the manager and employer while maintaining a transparent documentary trail.
What if the judgment was delivered after bankruptcy ended?
A separate review is needed: when the claim arose, whether it was disclosed in the proceedings, what the court established and when payment was received. The judgment date alone does not automatically determine the treatment of the entire award.
