Buying a land plot with borrowed funds in Russia can combine a sale transaction, a loan agreement and a mortgage or other pledge arrangement. These documents should be checked together: a lender’s financing decision does not replace verification of the plot, the seller’s title or the registration records.
Short answer. A pledge gives the secured creditor priority over the pledged property within the limits set by law and the agreement. Rights to the plot and any registered encumbrance must be examined before the transaction is completed.
Check the plot before signing
Obtain current information from the Unified State Register of Real Estate, identify the cadastral number, boundaries, permitted use, existing rights and registered restrictions. Check who is selling and whether consent or other transaction documents are required in the particular case.
Read the financing and security documents together
The loan agreement explains the debt. The pledge or mortgage documentation identifies the secured obligation and the property. The scope of secured claims may include not only principal but also items specified by law or agreement, so the documents must be read as a package.
Practical sequence
- Verify the seller, plot and current register information.
- Compare the sale terms with the lender’s conditions and proposed security.
- Check whether the property may be mortgaged and whether another encumbrance already exists.
- Make sure the transfer of title and registration actions are documented through the applicable registration process.
- Keep the signed agreements, payment evidence and registration extracts.
