Targeted assistance to someone affected by an emergency may be protected from enforcement during personal bankruptcy. However, a fire, flooding or another event does not make every subsequent transfer untouchable. The legal basis, evidence of the event and a link to the particular payment are essential.

Which assistance is protected by law?
Article 101(1), paragraphs 14 and 18, of Federal Law No. 229-FZ protect specified payments following emergency circumstances. Paragraph 14 covers one-off material assistance related to a natural disaster or other emergency circumstances, financed from the listed sources or other sources. Paragraph 18 separately identifies relief for emergency victims, including assistance following the loss of essential household property and relevant lump-sum benefits following death or injury.
In bankruptcy, these grounds are considered alongside Article 213.25 of Federal Law No. 127-FZ. A protected payment cannot be distributed to creditors merely because it arrived after asset realisation began. The particular funds must nevertheless be shown to fall within a protected category.

A fire does not automatically entitle you to a payment
Eligibility for public assistance and the right to retain an awarded payment are separate questions. According to the Russian Emergencies Ministry guidance, eligibility, recipients, amounts and procedures depend on the level of the emergency and the applicable regulations. Local authorities may also provide assistance following municipal-level emergencies.
Ask the administration or competent authority which programme applies to your event, where to apply and what evidence establishes eligibility. Do not apply amounts or conditions from a news report about another region to your own situation. A fire certificate is useful but does not replace the decision awarding a specific payment. Under paragraph 14, the emergency circumstances and the assistance basis require their own assessment; not every such payment should mechanically be tied to a single formal administrative emergency status.
What to do before the payment arrives
- Obtain the award records. Keep the decision, employer order or payer letter identifying the amount, beneficiary and reason for assistance. Request a copy if the document was lost.
- Notify the financial manager. Provide the case number, event description, expected amount and legal grounds for protection. Retain evidence of delivery.
- Arrange lawful access. Request written arrangements for releasing the protected money and any necessary instructions to the bank. Do not independently open a new card to bypass asset-realisation restrictions.
- Trace the credit. Obtain a complete statement showing the date, amount, sender and purpose. If assistance arrives in several transfers, match each transfer to the award decision.
Paragraph 1 of Supreme Court Plenum Resolution No. 48 explains exclusion of protected funds and dispute resolution: the financial manager addresses the issue first; unresolved disagreements are determined by the commercial court handling the bankruptcy case. Sending a request to the manager is not itself a court order prohibiting distribution of the disputed amount.
If the account is blocked or money has been withheld
Ask the bank to explain the restriction and provide transaction records. Distinguish three situations: the card is unavailable because of the bankruptcy account regime; the manager has treated the amount as available for distribution; or money was debited under an enforcement document. The appropriate recipient of a claim and the remedy differ.
Identify the specific payment in your written request to the manager. Ask for the protected amount to be excluded, for instructions on receiving it and for a written response. A dispute requires the statement, assistance documents, correspondence and legal grounds for the court. If distribution is imminent, separately assess whether interim measures are necessary; their grant is not guaranteed. Where money has already been debited, a refund cannot be promised on the strength of one letter: first identify the transaction basis and the recipient of the money.
Illustration: relief and wages in one account
After an emergency, a person is awarded assistance for the loss of essential household property. Wages arrive in the same account that month. The person gives the manager the award decision and a statement showing the two separate credits. The relief is assessed under its specific protection; the wages follow their own rules. Neither treating the whole account balance as protected nor classifying the relief as ordinary wages is justified automatically.

Frequently asked questions
Is an insurance payment after a fire automatically protected too?
The material-assistance rules do not provide an automatic answer. Insurance compensation has a different legal basis. The policy, insured property, beneficiary and consequences of the loss need separate analysis, particularly where the only home is involved. This guide does not determine who should receive a particular insurance amount.
Can employer assistance be protected?
Yes. A non-government source does not prevent paragraph 14 from applying. However, the order and other records must establish one-off assistance related to emergency circumstances, not an ordinary bonus or annual payment.
Can I withdraw the money as soon as it arrives?
Do not treat a payment’s protected status as permission to bypass the account regime during asset realisation. Arrange lawful access with the manager and bank in advance. A different bankruptcy procedure requires a separate check of the applicable rules.
Must I disclose relief that is not intended for creditors?
Yes. Disclose the receipt and its purpose to the manager. Documents separate relief from other funds and support exclusion. Concealment is not a method of protection.
