Identifying a Socially Significant Asset
Article 129 includes infrastructure necessary for residents: educational and medical facilities, water, heat, gas and electricity systems, wastewater and waste facilities, street lighting and local-improvement infrastructure. The Initial Tender
Socially significant assets, cultural-heritage assets and other property requiring a tender are sold under Article 110. Mandatory conditions include proper maintenance and designated use. Utility infrastructure conditions also address regulated tariffs and statutory concessions for relevant consumers.
If the Tender Fails
The creditor meeting or committee determines the next route: a new auction, a public offer under Article 139, or invitations for offers during thirty days after notice publication. A public-offer bidder or offeror must still agree to enter into the municipal agreement implementing the social conditions.
Municipal Agreement and Termination Risk
After a tender, public offer or accepted offer, the local authority enters into an agreement with the buyer. A substantial breach may lead to court termination of both the agreement and sale contract. The asset then passes to the municipality and the purchase price is reimbursed from the local budget.

Transfer to the Municipality

Assets withdrawn from circulation follow a different rule in Article 132: their owner is notified and must accept or reassign them.
