RUSSIAN BANKRUPTCY AND PROTECTED PAYMENTS
Lump-sum and monthly insurance payments under Federal Law No. 125-FZ serve a specific purpose. They must not automatically be distributed to ordinary creditors as wages. However, protection is not identical for every receipt following an injury or every claim against the recipient.

The award decision matters more than a general label such as “Social Fund transfer”.

Which insurance payments does this guide cover?
Article 8 of Law No. 125-FZ distinguishes temporary incapacity benefits, lump-sum and monthly insurance payments, and reimbursement of additional rehabilitation expenses. These are not interchangeable categories.
This guide focuses on insurance payments to a person injured in a workplace accident or affected by an occupational disease. Under Article 10 of that law, an award to the insured person depends on loss of occupational capacity resulting from the insured event, established by a medical and social assessment. Receiving treatment after an injury alone does not identify the legal nature of a transfer.
Does the payment enter the bankruptcy estate?
Article 101 of Law No. 229-FZ protects compensation for injury to health and compulsory social insurance benefits, subject to statutory exceptions. Temporary incapacity benefits are expressly excluded from paragraph 9 protection. It is therefore incorrect to call every sick-leave payment entirely untouchable insurance money.
At the asset-realisation stage, protected funds are addressed under Article 213.25 of the Bankruptcy Law and paragraphs 1–2 of Supreme Court Plenum Resolution No. 48. Disclose the payment and evidence of its basis to the financial manager; a dispute over exclusion is resolved by the court handling the bankruptcy. Protection does not permit concealing an account or independently changing how it is operated.
Obtaining an insurance award and excluding money received from the bankruptcy estate are different matters. An insurer’s refusal to award benefits cannot be corrected merely by writing to the financial manager. Conversely, an award decision does not replace reconciliation of actual receipts.

Exception: child maintenance and certain injury-related claims
The Supreme Court expressly explained that maintenance for minor children is withheld from monthly insurance payments awarded following a workplace accident or occupational disease: Question 3 of its third-quarter 2013 review, approved on 5 February 2014. The older list mentioned there has been replaced, but the current list under Government Resolution No. 1908, paragraph 2(m) also includes compensation for injury to health.
Article 101(2) permits enforcement against health-injury compensation for maintenance of minor children and obligations arising from the death of a breadwinner. Where such claims exist, retaining the entire payment cannot be promised without examining enforcement documents and deductions already made.
What to send to the financial manager
- The award decision. Identify the payment, recipient, legal basis and date. If the document is missing, request a copy from the awarding authority.
- A calculation. Separate the lump sum, monthly accruals, arrears for earlier periods and deductions. A screenshot of the total card balance is not a substitute.
- A bank statement. Match each receipt to the decision and calculation. If the transfer purpose is unclear, ask the payer for written confirmation.
- A written request. Specify the case number and transfers, request exclusion of protected funds and ask how future payments should be received. Attach evidence and retain proof of delivery.
- Evidence of a disagreement. Record the manager’s position if the request is rejected or remains unresolved. A court application needs the disputed amount and grounds, not merely a general reference to poor health.
Illustrative example: one account, different sources
An account receives a monthly insurance payment for loss of occupational capacity and wages for part of a month. The debtor attaches two calculations, marks the transfers on the statement and requests separate treatment. They do not claim that the entire account balance is protected simply because an injury occurred. Any child maintenance already withheld from the insurance payment is also shown. This example illustrates reconciliation, not a guaranteed court outcome.
Frequently asked questions
Several months were transferred together. What should I do?
Request a breakdown by period and type of accrual. The amount alone does not establish the payment’s nature. If different benefits were combined or money moved between accounts, prepare the complete evidence trail.
Is a disability certificate enough?
No: it does not explain which particular transfer was received. The award decision and calculation are needed. Disability status and loss of occupational capacity must not be treated as interchangeable in the documentation either.
Must I disclose an award made after bankruptcy began?
Yes. Notify the financial manager in writing and attach the documents. Do not wait for a recurring receipt to be incorrectly recorded as ordinary income.
The bank blocked access despite the payment being protected. What next?
Identify whether the restriction concerns account operation in bankruptcy or an enforcement debit. Give the statement and supporting documents to the manager; if money was debited, request transaction details from the bank. The next application depends on the established cause. Do not transfer funds to someone else’s card to evade the restriction.
