Real Estate Agency Agreement: What to Check Before Signing

Short answer: an agreement with a real estate agency is useful when it clearly states the actions the provider will take, when and for what the fee is paid, which information the client receives and who may act on the client’s behalf. The contract label does not replace a clear service description.

Define the service scope

List the agency’s actions separately: finding a property or buyer, arranging viewings, negotiations, document collection, payment support, preparing a draft agreement or other tasks. A phrase such as “full support” without detail can lead to different expectations about the work.

Check fee and payment trigger

The agreement should clearly state the fee, additional expenses, when they arise and how the provider’s actions are confirmed. Avoid unverifiable expense wording or terms that do not make clear which action or result triggers payment.

Separate assistance from authority to represent

Showing a property or handing over documents is not the same as authority to sign contracts or handle funds for the client. If the agent receives representative authority, check its scope, duration and limits. A power of attorney is considered separately from the service agreement.

Consumer information

Rospotrebnadzor notes that before the contract, the provider should give consumer information about the services, including their scope, price, procedure and timing; the agreement should set out the agency’s obligations and limits of authority in dealings with third parties. Before signing

Read clauses about withdrawal, reporting, personal-data processing, advertising the property and handing over documents. Keep the final agreement with appendices and correspondence about material arrangements.
