Left Without Movement Means Time to Cure, Not a Bankruptcy Refusal

What the Order Means

Article 128 of the Commercial Procedure Code and Article 44 of Federal Law No. 127-FZ address defects in the filing. The court specifies the reasons and a correction period. Timely correction preserves the original filing date; failure to cure leads to return. This is not a finding that the petition is unfounded or a ruling on debt discharge.

How to Prepare Your Response

Identify the court, reference or case number, applicant and date of the order. Answer each point in sequence, explaining what was corrected and which attachment proves it. Instead of saying “documents attached,” identify the statement, bank, covered period and attachment number.

Check every page for legibility, the signature, representative authority and consistency between creditor-list amounts and your explanations. If a required document was already filed, identify the file, submission date and receipt confirmation. If an event or document does not exist, such as a marital agreement never concluded, explain this clearly rather than leaving the point unanswered.

If a Bank or Agency Delays a Document

A court-appointed period may be extended under Article 118. Apply in advance with reasons: when the information was requested, what response you received, why you cannot comply and the specific new date sought. Attach the request, evidence of receipt and the organization’s response, if available.

Submitting the application does not itself extend the deadline. Send the documents already available, follow the court’s decision and continue addressing other defects. Extension of a court-appointed period and restoration of a missed statutory time limit are different procedural matters.

Example: An Archived Statement Takes Longer

The creditor list and inventory are ready, but the bank confirms that an archived statement will arrive later. The applicant sends the completed part, explains the remaining defect and requests a specific additional period with evidence of the request. This lets the court assess the delay but does not guarantee an extension.

Two Important Corrections to Older Templates

Paragraph 12 of Supreme Court Plenum Resolution No. 45 provides a special rule for mandatory debtor filing under Article 213.4(1): missing documents listed in paragraph 3 are requested after admission during case preparation. The ordinary return sequence should not automatically be applied to this situation; the grounds for mandatory filing must be established.

The manager’s remuneration deposit is different from the petition’s required particulars. Current Article 213.4(4) requires the citizen to pay after admission and before the merits hearing, stating the case number. The petition itself must identify the SRO’s name and address. An old template requiring this deposit before filing should be checked against the current rule.

How to Check the Outcome

Keep confirmation of dispatch and receipt of supplements, not just local copies of files. Check the filing reference and the subsequent order: admission, extension or return. Do not rely on posting papers on the final day without allowing for delivery and the order’s directions.

If the petition has already been returned, sending extra documents does not automatically revive it. Assess a new corrected filing or an appeal against return. If you disagree with an objection, explain your position with supporting records; silence is not a procedural response.
