Read the insurance exclusions

A waiver may not cover intoxication, an unlisted driver, gross negligence or leaving the scene.

Bankruptcy does not transfer ownership of the rented car

The vehicle remains third-party property. It should be identified by the agreement and registration data if questions arise during an inventory. The practical risk is usually not sale of the rental car but a new current debt, loss of deposit or damage claim.

Article 5 of Federal Law No. 127-FZ treats qualifying obligations arising after acceptance of the bankruptcy petition as current. Article 213.27 gives current claims their own payment order. This does not make every rental expense automatically reasonable or payable from the estate; purpose, amount and available funds still matter.

When a car may be a justified expense

Work, disability, care responsibilities or absence of realistic transport can explain the need, but proof should be contemporaneous. Keep the route, assignment, medical or family context and a comparison with alternatives. A premium vehicle chosen for convenience is harder to justify than a proportionate solution.

If a third person pays, record whether it is a gift, reimbursement, employer expense or a new loan. An unexplained transfer can create more questions than the rental itself.
