Bankruptcy During Pregnancy in Russia: Benefits and Property

Short answerPregnancy does not prevent an individual from filing for bankruptcy in a Russian commercial court. It does not, by itself, ules. Pregnancy does not replace the debt and enforcement checks.

Can a pregnant woman file for bankruptcy?

Yes. Federal Law No. 127-FZ does not prohibit a filing during pregnancy. The court applies the ordinary tests: debts, income, property, transactions, enforcement proceedings and the debtor’s good faith. Discharge is not automatic and does not cover every category of obligation.

The out-of-court MFC route is available only if all conditions in Article 223.2 are met. Pregnancy itself is not a special eligibility ground. See the MFC bankruptcy conditions.

Practical point: using a separate account for social benefits can make their source easier to prove, but it does not replace documentary evidence.

Court bankruptcy or MFC

In court bankruptcy, a commercial court considers the petition, a financial manager participates, and assets and transactions are reviewed under Chapter X of Law No. 127-FZ. MFC bankruptcy is free but is available only when every statutory condition is satisfied.

Property and bank accounts

Under Article 213.25 of Law No. 127-FZ, the debtor’s property generally enters the bankruptcy estate except for legally protected assets and funds excluded by the court. Pregnancy does not create a new list of exempt property. However, the purpose of social payments and the necessary support of the debtor and dependants must be respected.

Step-by-step preparation

  1. List the debts. Separate loans, taxes, utilities, child support and potentially non-dischargeable claims.
  2. Review enforcement proceedings. For MFC, the grounds and dates matter, not only the amount.
  3. Classify receipts. Identify benefits, child support, salary, freelance income and family transfers.
  4. Review property and transactions. Include housing, shares, vehicles, accounts and relevant transactions.
  5. Collect family records. Marriage, children, pregnancy, dependants and necessary expenses may be relevant.
  6. Select the route. Compare court rules with Article 223.2 MFC conditions.
  7. Prove the payment purpose. Keep award decisions, certificates and bank statements with income codes.

After the child is born

The family composition changes, and new protected benefits and necessary expenses may arise. During an ongoing court procedure, the financial manager should be informed and supporting documents supplied; a court application may be required. There is no single automatic amount retained for every family.

Frequently asked questions

Can a loan taken before pregnancy be discharged?

Pregnancy date does not decide the issue. The court considers the debt type, how it arose and the debtor’s conduct.

Can maternity allowance be taken?

Public payments to pregnant women and citizens with children are protected by Article 101(1)(12) of Law No. 229-FZ. The source and purpose must be proved.

Can I use MFC?

Only if Article 223.2 conditions are met. Pregnancy is not a separate ground.

Is the spouse’s income relevant?

Family income and common property may matter, but ownership and the estate are determined from documents and the applicable marital property regime.

Must the birth be reported during the case?

Yes. Changes in family composition, benefits and expenses should be documented and reported to the participants in the procedure.
