A Russian leasing company’s bankruptcy does not automatically place every leased asset into an unrestricted bankruptcy estate or terminate every lease. Each asset requires a separate review of title, possession, registration, contract type, buyout terms, payments, termination and final balance. Only then can the debtor’s property be separated from third-party assets and monetary claims from rights in rem.

Start with an Asset File
Create one record per contract: parties, asset, owner, possessor, registration, insurance, arrears, buyout price and termination status. As a general rule, an asset delivered to a lessee remains the lessor’s property until title passes under the agreed conditions.
What Enters the Estate
Once liquidation proceedings open, the insolvency administrator inventories the debtor’s property and pursues third-party claims. The estate may include assets owned by the lessor, receivables, contractual rights and a monetary balance. Third-party property and title already transferred should not be included mechanically.
Active and Terminated Contracts
Bankruptcy alone does not replace contract and statutory analysis. Check continued use, post-petition charges, termination notice and return. Where return is required, document condition, completeness, location and dismantling or transport costs.
Finance-Lease Balance
Russian Supreme Court guidance compares reciprocal performances and determines the closing obligation with reference to the returned or retained asset’s value. A reliable claim therefore cannot be based only on arrears or only on the buyout price.

- establish asset value at the relevant date;
- account for financing, lease charge and proven costs;
- calculate the final balance.
Registered and Current Claims
Pre-petition monetary obligations are generally submitted to the claim register within the applicable period. Obligations arising after the petition is accepted are tested under current-payment rules. The legal origin of the payment, rather than invoice or demand date alone, controls classification.
