Can a person file while on maternity or parental leave?
Article 213.4 of Federal Law No. 127-FZ connects filing to financial circumstances and liabilities, not employment status. A woman may file during pregnancy, maternity leave or childcare leave. The absence of current salary does not prove insolvency automatically: the court checks debts, default, property, income and the realistic ability to perform obligations.
Out-of-court bankruptcy through an MFC is available only where the special Article 223.2 conditions are met. Leave status does not replace the required enforcement and debt checks.

Article 101 of Federal Law No. 229-FZ lists income protected from enforcement and applies in bankruptcy through Article 213.25. The everyday term “maternity money” covers several legally different payments, so official records matter.
Subsistence minimum and a child
The debtor retains the applicable subsistence minimum and may claim amounts for qualifying dependants. Provide birth certificates, evidence of residence and support, the other parent’s income and benefit records. Exceptional necessary expenses, such as treatment, require a separate documented request.
Family property
Ordinary child belongings should not be confused with valuable debtor property. Maternity-capital funds and housing bought with them require separate analysis of children’s shares and security interests. Joint marital property may enter the process subject to the non-debtor spouse’s share.

- income, benefit and account records;
- Social Fund decisions and statements with income codes;
- children’s birth certificates and dependant evidence;
- marriage, marital-property and maternity-capital documents;
- enforcement records for the MFC-route test.
Practical checklist
- Separate salary, benefits, maintenance, compensation and family transfers.
- Obtain the official award decision for each payment.
- Test court and MFC eligibility without assuming a result.
- Disclose accounts, benefits, property and family circumstances.
- Agree the release of the subsistence minimum and protected payments.
- If an account is blocked, provide evidence to the bank and manager and take unresolved disputes to court.
