Survivor pension and benefits
It is unsafe to promise protection for every similarly named payment. Article 101 of Federal Law No. 229-FZ protects specified survivor pensions and budget-funded payments, but the exact type and funding source matter. The case should include the SFR or other authority’s decision, bank statements and the correct income code. Mixing protected and ordinary funds on one account should be explained with records.
Preparation sequence
Separate creditors
Prepare distinct lists of personal debts, alleged common debts and inheritance claims.
Obtain probate records
Collect the death certificate, notary information, acceptance or refusal documents and asset valuation.
Determine the property regime
Check acquisition dates, funding, shares, any marriage contract, division and sole housing.
Classify income
Document salary, pension, benefits, insurance and other payments separately.

FAQ
Is the widow liable with all her assets for her husband’s debts?
Not automatically. Liability for inherited debts is limited to the value inherited, while the alleged common nature of a marital obligation is a separate issue.
Does an inherited apartment enter her personal estate?
Accepted inheritance becomes the heir’s property, but sole-housing protection, security and timing require separate review.
Will a survivor pension be retained?
The exact payment and source must be established. Payments covered by Article 101 of Law No. 229-FZ are protected when properly documented and coded.
Can inheritance be refused before bankruptcy?
This is not merely a household choice. The refusal and its circumstances may be reviewed, so individual legal analysis is needed before action.
