Combat Veteran Bankruptcy in Russia: Payments and Property

Short answerA combat veteran in Russia may use personal bankruptcy. The statutory monthly veteran payment and funds connected with combat participation have special protection, whrt. Bankruptcy does not terminate veteran status. The court reviews debts, property, transactions, income and good faith; discharge is not guaranteed and does not cover every claim.

When MFC is available

Most veterans use the ordinary Article 223.2 conditions. A special ground applies to current and former SVO participants with the prescribed certificate and qualifying enforcement proceedings; a combat-veteran certificate alone does not replace those tests.

Veteran property

Veteran status does not protect every asset. A sole suitable home is generally protected by Article 446 of the Civil Procedure Code, subject to mortgage and excessive-value issues. A vehicle may be protected when necessary because of disability; veteran status alone creates no general vehicle exemption.

Step-by-step preparation

  1. List debts. Separate child support, personal-injury claims and other potentially non-dischargeable obligations.
  2. Classify payments. EDV, combat payments, salary, pension and regional compensation have different grounds.
  3. Review enforcement proceedings. They determine possible MFC eligibility.
  4. Collect status records. Certificates and award decisions prove payment classification.
  5. Disclose property and transactions. Include accounts, vehicles, shares and family transactions.
  6. Document family expenses. Dependants, treatment and rehabilitation require evidence.

Can veteran EDV be taken?

EDV under Article 23.1 of Law No. 5-FZ is a protected category when its source and purpose are proved.

Does veteran status continue?

Yes. Personal bankruptcy does not itself terminate combat-veteran status.

Is the entire pension protected?

There is no universal full exemption for every pension. The legal ground and retained minimum must be distinguished.

Is a veteran certificate enough for MFC?

No. Article 223.2 conditions apply, and the special SVO route requires separate prescribed evidence.

Can a vehicle be retained?

Veteran status alone does not create immunity. Protection may apply, for example, when transport is necessary because of disability.
