Where to Find a Russian Bankruptcy Claims Register and Obtain a Copy

📂 The creditors’ claims register differs from the public bankruptcy-notices register. EFRSB contains notices; an extract concerning your claim or a certified register copy is requested from the person maintaining it, subject to statutory conditions.
01 · Identify the documentNotice, court order, extract or full register.
02 · Establish entitlementCreditor status and representative authority.
03 · Check the responseDate, amount, components, priority and certification.

What is publicly searchable

To establish whether a counterparty is bankrupt, use the EFRSB and court-docket status guide. This page concerns a different task: checking a claim entry and obtaining documentary evidence.

An extract also helps reconcile repayments, components and priority. A debt mentioned in correspondence does not by itself prove admission.

Who can obtain an extract or copy?

Article 16(9) requires the practitioner or register keeper to send the creditor or authorised representative an extract stating their claim’s amount, components and priority within five working days after receipt of the request. Where the debt owed to that creditor is at least 1% of total creditor debt, a certified register copy is provided. Exactly 1% meets the threshold.

Preparation and dispatch costs are borne by the creditor. Request the amount and reimbursement method and preserve payment evidence. Court-file access under Article 41 of the Commercial Procedure Code serves a different purpose.

Check the 1% threshold

Hypothetical example: RUB 100,000 is owed to the creditor and total creditor debt is RUB 10,000,000. The calculation is 100,000 ÷ 10,000,000 × 100% = 1%. If the inputs are correct, the threshold is met. RUB 90,000 against the same total gives 0.9%.

Do not substitute asset value, number of creditors or the amount of your own lawsuit as the denominator. If the total is unknown, say so and request confirmation of the amount and calculation date. Arithmetic alone does not settle a dispute over the underlying inputs.

Prepare and send the request

  1. Identify the debtor, taxpayer number and bankruptcy case.
  2. Identify your claim, admission order or other entry basis, amount and priority shown by your records.
  3. Specify whether you require your own extract or a certified copy under the 1% condition.
  4. State the delivery address and method; attach representative authority.
  5. Preserve evidence of receipt and the response concerning costs.
✉️ Short request outline

“In case [number], concerning [debtor and taxpayer number], please provide a register extract stating my claim’s amount, components and priority as at [date]. If the condition in Article 16(9) of Law No. 127-FZ is met, please send a certified register copy. Please state preparation and delivery costs and reimbursement arrangements. Claim basis: [order, date, amount]. Delivery: [address]. Attachments: [authority and evidence].”

Missing or inconsistent information

Compare the document date with later orders, repayments and creditor substitutions. An EFRSB notice of receipt of a claim differs from admission: Article 16(7.2) distinguishes these events. Retain both notices where available.

If no response arrives, establish receipt, expiry of the period and the correct addressee. A further application should identify the actual breach and requested remedy. Assess personal-data restrictions before publishing a copy received.

Frequently asked questions

Can the full register be downloaded using only a taxpayer number?

Public notices and a certified full register have different access regimes. The identifier helps locate the case and addressee but does not itself confer copy entitlement.

Does a holding below 1% mean no documents?

The threshold concerns a full copy. Article 16(9) separately provides an extract concerning the creditor’s own claim.

Does publication of my claim mean it is admitted?

No. Submission and admission are separate events. Check the court order and register entry.
