Recovering a Debt under an IOU: Evidence, Demand and Court

An IOU may confirm that money was transferred under a loan arrangement and record the repayment terms. Recovery depends not simply on the words “I will repay”, but on the document’s contents, the due date, signature, evidence of the money transfer and the borrower’s position.

Short answer

An IOU does not automatically guarantee recovery. A court assesses its wording together with all other evidence. Before going to court, identify the repayment date, calculate the claim and preserve the original document.

What does an IOU prove?

The Russian Civil Code permits a borrower’s IOU or another document as evidence of a loan and its terms. Where the lender is an individual, the loan is formed when the money is transferred. The central issue is therefore whether the document and the surrounding evidence establish the transfer, amount, parties and repayment obligation.

An IOU is more useful where it identifies the date, parties, amount in figures and words, receipt of the money, repayment date and the borrower’s signature. Missing information does not necessarily decide the dispute, but it makes other evidence and interpretation more important.

Evidence to collect

  • the original IOU and information about its origin;
  • bank transfers, statements, payment orders or relevant correspondence;
  • documents showing partial repayments or acknowledgment of the debt;
  • a calculation of the principal, contractual interest and default interest where legally justified.

If the borrower alleges that no money was transferred or challenges the signature, expert evidence, bank records and correspondence may matter. Witness evidence is subject to statutory limits and does not replace written proof where written proof is required.

Demand and court procedure

First check whether the repayment date has arrived. Where no date is stated, a special Civil Code rule governs repayment after the lender’s demand. A written demand normally states the amount, legal basis, voluntary payment deadline and payment details. It helps record the creditor’s position and may matter for calculating the claim.

The next step is to choose the suitable procedure based on the claim and documents: a court order or a claim. Cancellation of a court order does not end the claim; it may be pursued in ordinary proceedings. Jurisdiction, court fee, limitation periods and the composition of the claim depend on the facts.

Practical steps

  1. Keep the original IOU unchanged.
  2. Collect proof of the transfer and any repayments.
  3. Identify the due date and prepare a calculation.
  4. Send the borrower a reasoned written demand.
  5. Choose the court-order or claim procedure and attach the evidence.
