Bankruptcy Creditor Status in Russia: Meaning and Rights

A bankruptcy creditor is a statutory category, not a promise of preferential repayment. Article 2 of Russian Bankruptcy Law defines creditors under monetary obligations, subject to exceptions. Examine claim nature, when it arose, establishment in the case and the particular right separately. This guide mainly uses company bankruptcy as its context.
🧾 Identify the claimWhat is owed, its basis and who owns it.
📅 Identify the regimeWhen the obligation arose and the current procedure.
⚖️ Check the rightsFiling, participation and evidence for a vote.

Who can be a bankruptcy creditor?

Typical examples include a supplier owed payment for delivered goods, a lender or an assignee of a qualifying monetary claim. Both individuals and organisations can qualify. A contract label alone is insufficient: examine the obligation and special rules.

Article 2 contains exceptions, including authorised public bodies, specified life or health injury and additional statutory compensation claims, remuneration due to authors of intellectual works, and shareholder claims arising from participation in the debtor. Employment payments and other special claims also require their own classification. Not everyone owed money belongs to one category.

Ownership of a claim, its judicial establishment and the scope of procedural rights are related but distinct. Having a contract does not prove registration or an established voting right.

A bankruptcy creditor is distinct from the liquidation administrator: the former pursues its claim, while the latter performs a statutory procedural function. This page concerns creditor rights.

Current payments and the register

Under Article 5, current-payment classification generally turns on an obligation arising after acceptance of the bankruptcy petition, subject to exceptions. A late due date for an old delivery does not alone make it current. Continuing contracts and separate periods of performance need individual analysis.

Current-payment claims are not entered in the register. Article 35 allows those creditors to participate in matters involving infringements of their own current-payment rights. That is distinct from an ordinary registered creditor’s voting position. See company current payments.

A registered claim requires the correct application, evidence, applicable deadline and judicial review. A debt certificate or enforcement writ alone does not confirm a register entry; see the claim determination guide.

Check each right separately

  • Bankruptcy petition: separate standing conditions, not any unpaid claim.
  • Debt establishment: stage, time limit, basis, amount, priority and order.
  • File access and submissions: standing in the case or particular dispute and relevant materials.
  • Meeting participation: register at the meeting date, eligible amount and special restrictions.
  • Objections and appeals: affected right, proper remedy and deadline.
  • Repayment: priority, security, unpaid balance and available funds.

Article 34 identifies bankruptcy creditors as case participants, while individual actions follow the applicable rules. See the meeting preparation guide. Creditor status does not authorise unilateral disposal of debtor assets.

Evidence for identifying your status

📁 Documents before choosing the next step

Case number and stage orders; contract and amendments; performance records; calculation and payments; assignment evidence where applicable; debt judgments; security documents; bankruptcy determination and register data if available; relevant dispute records and representative authority.

Build one chain: basis → origin date → owner → unpaid components → regime → judicial establishment → intended action. Mark missing evidence and request it rather than filling gaps with assumptions.

Hypothetical example: a judgment records RUB 400 000 principal and RUB 80 000 penalty, a total of RUB 480 000. Do not automatically use the full total as votes: sanctions do not increase voting amounts under Article 12. Repayment separately depends on priority and funds. This illustrates distinct rights, not a predicted recovery.

Why the status does not guarantee recovery

Payment depends on the estate, current expenses, special priorities and other claims. A large debt does not prove sufficient assets; a small debt does not eliminate procedural protection. Do not assess recovery from the term “bankruptcy creditor” or the register total alone.

After determination, reconcile components and balance, examine documents relevant to your rights, participate through the correct procedure and retain orders. Distribution priority and voting share answer different questions.

Frequently asked questions

Can an ordinary individual qualify?

Yes. The category is not restricted to banks or companies. Claim nature, ownership and statutory exceptions matter.

Must a creditor wait for liquidation proceedings to claim?

No. The category’s name does not restrict filing to that stage. Follow the current procedure and its deadlines.

Is every shareholder claim participation-based?

No. Article 2’s exception concerns obligations arising from participation. Another basis, such as a loan, requires separate analysis and relevant special rules.

Does a debt judgment automatically give votes?

No. Review the register at the meeting date, eligible components and special restrictions.
