Who Repairs a Balcony in a Russian Apartment Building?

Responsibility for balcony repairs in an apartment building depends on the element that is damaged. A balcony slab may be common property, while elements used only by one flat can require a separate analysis.

Current rule. The rules on common property include structural enclosing elements of an apartment building, including balcony and other slabs. The Ministry of Construction reaffirmed this position in 2026. The particular component, technical documents and management agreement still need to be checked.

Common property and private elements

Government Resolution No. 491 governs maintenance of common property. Balcony slabs are expressly treated as structural elements of the building. This does not mean every item located on a balcony has the same legal status. Glazing, finishes, owner-installed equipment and an enclosure may need separate assessment depending on their function and the house documentation.

What to do if damage is found

  1. Document the condition with photographs, video and a written description.
  2. Notify the management organisation or other responsible management body in writing and request an inspection.
  3. Keep the inspection record, technical conclusion, correspondence and evidence of any emergency measures.
  4. Check the management agreement, list of common property and the approved repair plan before disputing responsibility or cost.

Payment and remedies

Owners bear expenses for common property proportionally through the statutory housing-maintenance mechanism. The management organisation’s duties are determined by law, the management agreement and the applicable list of works. Whether a particular repair is current maintenance, capital repair or a private-owner expense requires a technical and legal assessment; it should not be decided merely by the balcony’s location.
