Restoration of parental rights is possible only through court proceedings. The court assesses whether the parent has changed their conduct, lifestyle or attitude to the child’s upbringing, with the child’s interests as the primary consideration.
What matters
- the reasons for deprivation and how they have changed;
- documents and other evidence of the current situation;
- the child’s view where required by law;
- participation of the guardianship authority and prosecutor.
When restoration is not available
Restoration is not available where the child has been adopted and the adoption has not been cancelled. The court may also refuse if restoration conflicts with the child’s interests.
A lawyer can help prepare documents and a position, but cannot promise the court’s decision.
