Appealing a Debt-Recovery Judgment in Russia

An appeal in a debt-recovery case is not a new claim. It challenges a first-instance decision that has not entered into legal force and must identify procedural or substantive errors affecting the outcome.

Who may appeal

The parties and other persons participating in the case have the right to appeal. A person who was not joined to the case may also appeal if the court resolved a question concerning that person’s rights or duties.

Time limit and filing route

In civil proceedings, an appeal is generally filed within one month after the decision is made in final form, unless the Code sets another period. It is filed through the court that adopted the decision, on paper or electronically. A missed deadline requires a separate request for restoration of the procedural period together with the appeal and supporting documents.

What to check before filing

  • the full decision and the reasoning of the first-instance court;
  • the evidence admitted and the evidence not addressed;
  • the calculation of principal, penalties, interest and costs;
  • the applicable procedural deadline and proof of sending copies;
  • the required state-duty and representative documents where applicable.

Debt-specific issues

In a debt case, the appeal normally focuses on the source of the obligation, payment evidence, limitation period, calculation and the court’s assessment of objections. New arguments must be tied to the procedural rules and the actual record.

Legal framework
