Setting Aside a Russian Default Judgment: Grounds and Procedure

Short answer: a Russian default judgment is not set aside merely because the defendant missed the hearing. The defendant normally needs to show both a valid reason for absence and circumstances or evidence capable of affecting the result. The available route and time calculation depend on actual service of the judgment and the procedural history.

When a default judgment may be issued

Chapter 22 of the Russian Civil Procedure Code governs default proceedings. Proper notice to the defendant, non-attendance, the absence of a timely explanation of a valid reason, and the claimant’s position on default procedure matter. The label “default judgment” alone does not prove that the procedure was lawful: notices, case materials and the record need review.

Grounds for setting it aside

Article 242 of the Civil Procedure Code links cancellation to two elements:

  • the defendant had a valid reason for non-attendance and could not notify the court in time;
  • the defendant relies on circumstances and evidence capable of affecting the decision on the merits.

A bare assertion of defective notice or simple disagreement with the claim may not be enough for this particular remedy. Defects in service, illness, travel, an address change and new records can nevertheless be material when the case is assessed as a whole.

Preparing the application

  1. Obtain the full judgment and case material. Record the actual date the copy was received and examine postal records and notices.
  2. Choose the procedural route. An application to set aside a default judgment and an appeal have different rules; the proper choice depends on the stage of the case.
  3. Document the absence. Attach certificates, tickets, location documents, postal records or other verifiable material.
  4. Show why the merits may change. State defences and attach documents, calculations, correspondence or requests for evidence.
  5. Calculate the deadline carefully. The application is governed by Article 237 and runs from service of the copy. Do not calculate it solely from the judgment date without checking service and later procedural events.

What follows

If set aside, the case is reheard under ordinary civil-procedure rules. If the court refuses to set it aside, or another route is appropriate, an appeal may be available. Cancellation or restoration of a missed time limit cannot be promised: both depend on notice, evidence and the actual chronology.
