Access to a Russian bankruptcy case file: a creditor’s practical guide

Legal review: 4 October 2026 · Protecting a creditor’s interests

A creditor does not always have to wait for admission to the register before obtaining procedural access to a Russian bankruptcy case file. Article 16(10) of Law No. 127-FZ links participant status to filing a claim in the prescribed manner. A contract with the debtor or viewing the public case card alone is insufficient: the court must be shown the basis for access and the applicant’s authority.
Establish statusCheck how the claim was filed and which orders the court has made.
Identify documentsSpecify the main case, relevant separate disputes, supporting documents and calculations.
Watch deadlinesWaiting for access does not by itself stop the period for objections or an appeal.

Can a creditor inspect the file before its claim is admitted?

Yes. The absence of a final order admitting the claim does not by itself mean that procedural rights are absent. The second paragraph of Article 16(10) of Law No. 127-FZ gives participant status to creditors who file claims under Articles 71 and 100. Paragraph 25 of Supreme Court Plenum Resolution No. 40 of 17 December 2024 confirms their status and corresponding rights and obligations.

The access application should therefore establish not only the debt but also the filing of a claim in the bankruptcy case. Give the filing date, application details and any order accepting it for consideration. If the claim was left pending correction, returned or submitted outside the proper procedure, examine that procedural position first. A file-submission notification is not a substitute for checking what happened to the filing.

If the first-instance court refuses admission, paragraph 25 preserves that status until proceedings on appeals end in the higher instances listed there. This does not create perpetual access after the dispute finally ends or an automatic right to vote at a creditors’ meeting.

For the original claim, see the separate guide to admission to a company’s creditors’ register. This article addresses the next practical task: obtaining and reviewing court materials.

The entire bankruptcy file or only your separate dispute?

Article 41 of the Commercial Procedure Code permits a participant to inspect materials, take extracts and make copies. Paragraph 14 of former Supreme Commercial Court Plenum Resolution No. 35 extends access to all bankruptcy materials to persons participating in the case, regardless of whether they are directly involved in a particular separate dispute. An exception applies to persons participating only in a specific separate dispute.

For example, being a registered creditor and participating solely as the counterparty in a transaction challenge are different grounds for involvement. The access rights of one category should not automatically be attributed to the other. A person merely anticipating a future claim also needs a separate explanation of the basis for its procedural rights.

A broader map of procedural roles appears in participants in a bankruptcy case. Do not pass restricted access to outsiders or publish personal information from the file: inspection serves the exercise of procedural rights.

Why the public case card does not replace file inspection

The public commercial-court case card usually shows court orders and procedural progress. Contracts, bank evidence, calculations, objections and attachments may be restricted or held in paper volumes. A document missing from the public card is not necessarily missing from the court file.

An application can be submitted through the official “My Arbitr” service, identifying the case number, court and applicant. Article 41 makes electronic access subject to technical availability. Check the court’s notification for the scope and duration of access; there is no universal promise that access will open within a day and remain available permanently.

For paper inspection, establish where the volumes are and check the booking procedure on the particular court’s website. Transfer to another instance may change where you need to apply. General arrangements are discussed in the guide to inspecting commercial-court case materials.

A creditor’s application to inspect a bankruptcy file

The outline below explains the application’s structure. Complete the facts and remove inapplicable alternatives. It does not replace evidence of status or authority. Prepare the document for actual filing in Russian and in the required procedural form.

To the Commercial Court of [name]
Case No. [number]
Debtor: [name and identifiers]
Applicant: [creditor, address and contacts]

Application to inspect the case file

I have filed a claim against the debtor for admission to the register [date, amount and filing reference]. Its procedural status is [accepted for consideration / admitted to the register; court order details].

Under Article 41 of the Commercial Procedure Code and Article 16(10) of Law No. 127-FZ, and taking account of my procedural status, I request the opportunity to inspect case materials, take extracts and make copies.

In particular, the following are needed to prepare my position: [a specified creditor’s application, contracts, calculation, performance evidence, objections and attachments; separate dispute and volume identifiers, if known].

Where technically possible, please provide electronic access to these materials. If full electronic access is unavailable, please inform me of the arrangements and date for inspecting the relevant paper volumes.

Attachments: [evidence of filing the claim, court order, authority documents]. [Date and authorised signature].

A person participating only in one separate dispute must adapt the wording to state that ground for involvement and identify the relevant dispute materials. Do not describe yourself as a registered creditor if you do not have that status.

What to check once access is granted

  1. Document completeness. Match the application and each attachment against the inventory. Record missing pages, reverse sides, schedules and illegible scans.
  2. The competing claim’s basis and amount. Compare the contract, actual performance, payments and separate calculations of principal and penalties.
  3. The chronology. Record when the obligation arose, the claim was filed and accepted, and objections arrived.
  4. The procedural result. Distinguish the creditor’s application, its acceptance and the final determination of the claim. None is interchangeable with the others.
  5. An index of your copies. Keep volume and page numbers, dates and document names so that you can cite the evidence accurately.

If the review reveals grounds to dispute a claim, prepare reasoned objections to the creditor’s claim separately. Inspection provides material for analysis; it does not itself disprove the debt.

If access is missing or a deadline is approaching

First identify the cause: missing authority documents, an incorrect number, unclear applicant status, an unspecified separate dispute, volumes held by another court instance, or documents not digitised. Preserve the application and the court’s response and address the specific deficiency.

If unavailable documents prevent preparation, tell the court exactly what is required and why it cannot be obtained otherwise. An access request does not automatically suspend procedural deadlines. If a hearing has been scheduled, an adjournment requires separate reasons and a court decision.

Do not assume that joining the case later automatically permits challenges to every earlier order. Appeal periods and grounds must be checked separately, taking account of the type of order, procedural status and reasons for any missed deadline.

Frequently asked questions

Must I wait for admission to the register?

No. The law also gives participant status to a creditor who has filed its claim in the prescribed manner. Establish this in the application.

Is knowing the case number enough?

Usually for viewing the public card, yes. For restricted access, the court checks status and authority.

Can a representative inspect the file?

Yes, with proper evidence of authority. The court must be able to establish whom the representative acts for and in which case.

If only some files opened, is inspection complete?

Not if essential attachments or pages are missing. Record the gaps and request the missing part or paper volumes where necessary.

Does an inspection request extend the objection period?

Not by itself. Monitor the deadline separately and raise any procedural request with the court in time.
