Title transferred
The apartment generally belongs to the buyer and the seller is a creditor for the unpaid price.
Instalments remain
Review the seller’s statutory or contractual security and its registration.
Incomplete closing
Signing, registration, delivery and payment must be analysed separately.
Apartment and payment scenarios
| Situation | Baseline | Seller action |
|---|---|---|
| Title registered and price paid | The buyer owns the apartment; bankruptcy alone does not terminate the sale | Keep the contract, register extract and payment evidence |
| Title registered with instalments due | The seller has a monetary claim and may hold security | Check the register and file the secured claim |
| Contract signed but title not registered | The parties’ duties and performance stage require review | Do not mechanically deliver keys or papers |
| Deposit paid but no main contract | The dispute normally concerns money and the duty to contract | Review the preliminary agreement and deadlines |

FAQ
Is the apartment automatically returned?
No. A specific legal basis, remedy and court assessment are required.
Does seller security survive?
Russian Civil Code Article 488 provides seller security for a credit sale unless otherwise agreed. For real estate, the register entry and contract are critical.
Can the unpaid balance simply be collected?
The claim follows bankruptcy procedure, depending on its date, the case stage and security.
What if it is the buyer’s only home?
Immunity is assessed separately and security may materially change the result.
