In Russia, a marriage is dissolved either through the civil registry office (ZAGS) or through a court. The correct route depends mainly on whether the spouses have common minor children and whether both consent. A property dispute does not always require a court divorce: the property claim may be heard separately.
ZAGS or court?
| Situation | Where to apply | Important point |
|---|---|---|
| Both spouses consent and have no common minor children | ZAGS | A property dispute may be litigated separately and does not prevent this administrative route. |
| One spouse has been declared missing or legally incapable, or sentenced to more than three years’ imprisonment | ZAGS on the other spouse’s application | A final court judgment is required. Common minor children do not exclude this special route. |
| The spouses have common minor children | Court | Except for the special one-sided ZAGS cases described above. |
| One spouse objects or evades the ZAGS application | Court | Evasion includes refusing to submit a joint or separate application despite expressing no objection. |
Which court has jurisdiction?
A justice of the peace handles a divorce where there is no dispute concerning children. A district court is required if the claim asks the court to determine the child’s residence, contact arrangements, or another child-related dispute.
The general rule is filing at the defendant’s place of residence. The claimant may be allowed to file where they live if a minor child lives with them or health makes travel to the defendant’s location difficult. Jurisdiction must be checked against every claim joined to the divorce.
What the court claim should contain
- the court’s name and details of the claimant and defendant;
- the date and place of marriage registration and civil-record number;
- information about common children and their ages;
- whether the spouses agreed on residence, care, contact, and support for the children;
- where consent is absent, facts showing that the family cannot be preserved;
- the request to dissolve the marriage and any other claims that may properly be joined;
- a list of attached documents.
Russian law does not require the formula “incompatible personalities.” If both spouses consent, the court does not investigate the reasons. If one spouse objects, the claim should state the relevant facts without unsupported accusations.
Documents to attach
Core documents
Marriage record, proof that the defendant received a copy of the claim, and proof of the state fee or a statutory exemption or deferral.
If there are children
Birth records and any agreements concerning the children’s residence, support, and contact.
Additional claims
Calculations, income records, title documents, and other evidence depending on the relief sought.
Check the current state fee and payment details immediately before filing on the official court, government-services, or ZAGS website. Payment rules may change.
Timing and reconciliation
For a ZAGS divorce, state registration takes place after one month from the application. A court may not dissolve the marriage earlier than one month after the claim was filed.
If one spouse objects, the court may allow a reconciliation period of up to three months. If reconciliation fails and at least one spouse continues to seek divorce, the marriage is dissolved.
Restriction on a husband’s claim
Article 17 of the Family Code prevents a husband from commencing divorce proceedings without his wife’s consent while she is pregnant and for one year after the child’s birth. The Supreme Court explains that the rule also applies if the child was stillborn or died before turning one. The restriction does not prevent the wife from applying herself.
When the marriage legally ends
- for a ZAGS divorce, on the date the dissolution is entered in the civil-status register;
- for a court divorce, when the court judgment becomes final.
After a court judgment, the information is sent to ZAGS for registration. A new marriage cannot be registered until the divorce registration document has been obtained.
Frequently asked questions
Must divorce and property division be combined?
No. The claims may be filed separately. Separate proceedings may prevent a complex valuation and division dispute from delaying the divorce itself.
Can spouses use ZAGS if they dispute property?
Yes, if both consent to divorce and have no common minor children. The property dispute is handled separately.
What if the spouse agrees but refuses to attend ZAGS?
If that spouse evades submitting the required joint or separate application, the divorce proceeds through court.
Must a party personally attend the hearing?
A party may request consideration in their absence or use a representative, although the court may require personal attendance. The position and documents should be submitted in advance.
