Housing Privatisation in Russia: Key Steps

Housing privatisation in Russia is the transfer of an apartment or other residential premises from the state or municipal housing stock to citizens who occupy it under a social tenancy agreement. It is not the same as buying state property at an auction or purchasing an apartment on the market.

Short answer. Free housing privatisation has no statutory end date. Eligibility, the composition of the household, the status of the premises and the documents available still need to be checked for the individual apartment.

Who may use this route

The Housing Privatisation Law applies to Russian citizens who use premises from the state or municipal housing stock under a social tenancy agreement. The law allows acquisition into common ownership or into the ownership of one person, subject to the consent rules for people who have a privatisation right in the particular premises.

Why the deadline is not the main issue

The statutory restriction on the duration of free housing privatisation was removed in 2017. This does not mean that every residential premise can automatically be privatised, or that the procedure has no local document requirements. The starting point is the current legal status of the apartment and the social tenancy documents.

Household members and consent

People registered in the premises may have rights that must be considered in the transaction. The law contains specific rules for adults and for minors aged 14 to 18. Before preparing an application, identify every person with a potential privatisation right and check the documents that show the basis of residence.

What to check before applying

  • the current social tenancy agreement and the details of the premises;
  • the state or municipal status of the housing stock;
  • the persons registered and their legal basis of use;
  • any previous exercise of the privatisation right and relevant exceptions;
  • documents requested by the competent local authority for the particular municipality.

Ownership arises after registration

Privatisation paperwork and the transfer of the registered right are separate matters. The housing law links ownership of the acquired premises to state registration. Keep the transfer documents and confirm the resulting record in the Unified State Register of Real Estate.

When individual legal review is useful

Additional care is needed where a person is absent from the household, there are minors, the premises have a special legal status, or documents are incomplete. Do not treat an internet checklist as proof that a particular apartment is eligible.
