Divorce Without Court in Russia: ZAGS Procedure

A divorce without court proceedings in Russia may be registered by a civil registry office (ZAGS) when Article 19 of the Family Code permits it.

When is a ZAGS divorce available?

Mutual-consent route

Both spouses must consent to divorce and have no common children under 18. Adult common children do not prevent a ZAGS application.

A child of only one spouse whom the other spouse has not adopted is not treated as a common child for this purpose.

Unilateral route

One spouse may apply regardless of common minor children if the other spouse has been legally declared missing or legally incapacitated.

The same exception applies when the other spouse has been sentenced to imprisonment for more than three years.

When is a court necessary?

  • There are common children under 18.
  • One spouse objects to divorce.
  • A spouse avoids filing or registration.

The statutory unilateral exceptions remain available even if the spouses have common minor children.

A property dispute does not always block a ZAGS divorce. The marriage may be dissolved first and the property claim heard separately.

Divorce, child arrangements, maintenance, and division of property are separate legal issues.

How to file the application

Article 33 of Federal Law No. 143-FZ permits filing in person at ZAGS or electronically through the Gosuslugi public-services portal.

Filing through an MFC public-service centre is also possible where the selected centre provides the service.

A practical four-step scheme

1. Identify the route → joint application or one of the statutory unilateral grounds.

2. Complete the form → identity details, marriage record details, and surnames after divorce.

3. Pay the state fee → use the current payment details for the selected registry office.

4. Attend registration → after one month, with at least one spouse present.

If one spouse cannot attend filing

The spouses may submit separate paper applications. The absent spouse’s signature normally must be notarised.

Equivalent certification rules apply to persons in custody and other cases expressly listed in Federal Law No. 143-FZ.

Documents usually required

  • identity documents;
  • the application;
  • state-fee confirmation;
  • marriage record details.

For a unilateral application, attach the final court judgment establishing the relevant statutory ground.

If the marriage certificate is lost, ZAGS may verify the marriage through the Unified State Register; a duplicate is not always required.

Waiting period and registration

Divorce registration takes place after one month has elapsed from the date of filing.

For a joint application, at least one spouse must attend the registration. The marriage ends on the date recorded by ZAGS.

State fee in 2026

For a mutual-consent ZAGS divorce, the state fee is RUB 5,000 from each spouse.

For a unilateral divorce on the special grounds in Article 19, the fee is RUB 350.

Payment details should be checked immediately before payment because recipient details and service routes may change.

Use the state-fee calculator and confirm the result against official payment details.

Property, maintenance, and children

ZAGS only records the divorce. It does not divide property, award maintenance, or decide where children will live.

These issues may be settled by agreement or, where necessary, brought before a court in separate proceedings.

See the guide to indexation of maintenance payments.

Frequently asked questions

Can spouses with adult children divorce through ZAGS?

Yes. The restriction concerns common children under 18, not adult children.

Can property be divided after the ZAGS divorce?

Yes. Divorce registration and property division are separate legal matters.

Is the one-month period shortened by agreement?

No. The statutory period applies even where both spouses want an earlier registration.

Must both spouses attend registration?

No. For a joint application, the presence of at least one spouse is sufficient.

Can a foreign national use this procedure?

Potentially yes, but applicable law and recognition abroad should be checked for the particular citizenship and marriage record.
