Bank account funds at divorce require a review of when they were received, their source and transactions. An account in one spouse’s name does not by itself determine the legal status of the money.
What to collect
- account statements and payment purposes;
- documents showing the source of funds;
- any agreements between the spouses.
Agreement or court
Common property may be divided during marriage or after divorce. A property-division agreement must be notarised; in a dispute, shares and compensation are determined by the court from evidence.
