Documents to obtain first
Keep the dated notice, case number, court order introducing the procedure and appointing the administrator, request and reply, and payment records. Match identifying details: an identical name is insufficient.
Check the current stage in the commercial court case database and the EFRSB bankruptcy register. Retain the court order. Verify contacts against official records, especially where a new bank account is proposed.
Filing and the introduction of a procedure are different
| Verified position | Employer action |
|---|---|
| Only a statement about filing | Request documents; do not invent a new payment arrangement. |
| Debt restructuring introduced | Read the order and request; do not automatically apply realisation rules. |
| Bankruptcy declared and asset realisation introduced | Document the transfer arrangement under Article 213.25. |
| Procedure completed | Obtain the final order and verify the basis for changing previous instructions. |
During realisation, Article 213.25 governs control of estate assets and accounts. Monetary obligations owed to the individual involve the financial administrator’s powers. A request to use a relative’s card does not replace verification.
Separate wage transfers from deductions
Reconcile the period, gross pay, tax, lawful deductions, net amount, payment date and reference. The employer should not distribute the estate among creditors or independently choose the employee’s living allowance.
Labour Code Article 136 continues to govern pay dates and payslips. An ordinary employee-requested change of bank requires written notice at least 15 calendar days before payment; the special realisation regime needs separate assessment. Clarifying details does not justify indefinite wage delays.
Article 137 requires a statutory basis for deductions. If an enforcement document is already implemented, compare it with the court order and bailiff decisions. Do not mechanically cancel or continue deductions: the claim type and operative documents matter.
A practical reply outline
Article 213.9(7) allows the administrator to obtain asset and account information from organisations. Verify authority and the legal basis, then send relevant information through a verified channel. Avoid unnecessary disclosure of other people’s data or the entire personnel archive.

In response to request[date/reference] in case[number]: for employee[name], pay accrued for[period] was[amount], deductions were[tax and other sums with grounds], and[amount] was transferred on[date/reference]. Calculation and payment evidence are enclosed. To implement the proposed transfer arrangement, please clarify[specific discrepancy: account, period or amount] and provide[missing document]. Contact:[role/contact].
This adaptable outline is not a refusal to pay. Use actual figures; determine the deadline from the particular request’s legal basis.
A hypothetical reconciliation
Net monthly pay is ₽60,000. An instalment of ₽25,000 was already paid. The balance is ₽60,000−₽25,000=₽35,000. Recording both transactions and proving the first prevents a request for “this month’s salary” from causing a duplicate ₽25,000 payment.
This does not establish a protected allowance or authorise deductions. A dispute over excluding income from the estate needs a documented execution arrangement, not the employer’s own estimate of family spending.
HR issues and related reading
Dismissal, information access and position restrictions are separate from bank instructions. The employee-facing guide explains whether an employer will learn about bankruptcy. If the company itself is insolvent, use the different route for wages and payments in employer bankruptcy.
Frequently asked questions
Can payroll stop paying until bankruptcy ends?
Bankruptcy itself does not end wage accrual or payment deadlines. Establish proper execution and resolve documentary uncertainties before the next payment.
Is a screenshot with account details enough?
It does not establish authority or account ownership. Check the court order, official contacts and written instruction.
Should the entire team be informed?
Payroll and HR implementation requires access by authorised staff. A general announcement does not help implement a request.
