Customs Payments in Russian Corporate Bankruptcy: Priority and Documents

Priority of customs payments in Russian corporate bankruptcy depends on when the liability arose and what the assessment contains.

A late declaration adjustment or customs notice does not make the entire balance a current payment. Reconstruct the basis and date of each item first.

For a director, accountant of an importing company or creditor reviewing claims in its bankruptcy. Do not extend the example to an individual’s personal imports or every customs procedure. Primary provisions checked on 25 October 2026: Bankruptcy Law Articles 2, 5, 134 and 137, and EAEU Customs Code Articles 46 and 136. Future amendments are not applied.

📦 Separate the customs assessment by type

Article 46 of the EAEU Customs Code lists, among other customs payments, import and export duties, import VAT and excise, and customs fees. A fine, late-payment charge, duty and customs representative’s fee are not one debt item. The representative’s services have a contractual basis; public payments require review against the definition of mandatory payments in Bankruptcy Law Article 2.

🧾 Principal assessment

Check the payment type, declaration, calculation basis and amounts already credited.

⏱️ Late charges and sanctions

Identify a separate calculation and legal basis. Do not merge them into principal for distribution.

🤝 Contractual service

Review the representative’s, carrier’s or warehouse’s invoice against its own contract and performance.

🗓️ The liability date matters more than a late letter

Bankruptcy Law Article 5 generally classifies liabilities arising after the court accepts the bankruptcy application as current, unless the law provides otherwise. Obtain the actual acceptance order: the filing date and commencement of liquidation proceedings do not replace that dividing date.

For ordinary placement under release for domestic consumption, Customs Code Article 136(1) links the declarant’s import duty and tax liability to registration of the goods declaration. The article also contains special provisions, including a reference to Article 137 for release before the declaration is submitted. Do not transfer that rule to transit, temporary importation, personal goods or another special case without checking.

A later additional assessment needs analysis of its basis. Compare the original declaration, adjustments and customs decision: has the amount of an existing liability changed, or does a different legal ground apply? The date of a payment notice alone does not answer that question.

Illustrative timeline. The court accepts the application on 15 September. A declaration for the stated ordinary release was registered on 5 September, and a notice arrived on 10 October. The October notice alone does not establish current-payment status. If another declaration was registered on 20 September, assess its liability separately. This illustrates date comparison, not every adjustment or an actual case.

⚖️ Where does a customs claim rank?

During the company’s bankruptcy liquidation, distinguish two systems:

SituationGeneral ruleCheck
Principal mandatory payment is a registered claimUsually third-ranking claims of the authorised public body under Articles 134 and 137Basis, date, amount and the order establishing the claim
Import duty or import VAT qualifies as currentAs other current payments, generally fifth current-payment priority under Article 134Liability date, special circumstances and calendar order
Registered late-payment charges and financial sanctionsSeparate recording under Article 137(3), after principal and applicable interestSanction type, legal basis and a separate amount
An amount is already paid or creditedAvoid counting the same discharged amount againStatements, payment records and crediting information

Article 5 excludes current claims from the register. Priority over registered creditors does not mean immediate payment ahead of all other current creditors. Claims within a current-payment rank follow calendar order. Security, special expenses and status disputes need separate review; the table does not displace statutory exceptions.

General routes: company current payments and priority of registered creditors.

📁 Link the declaration to the outstanding balance

  1. Court order: date the application was accepted and current case stage.
  2. Customs records: declaration and registration details, procedure, release information, adjustments and assessment decisions.
  3. Calculation: separate duty, import VAT, fees, late charges and sanctions; basis and date for each item.
  4. Discharge: payment records, credits, balances and refunds identifying the liability they relate to.
  5. Dispute: notices and delivery evidence, appeals, judgments, the public body’s claim and attachments.

If records are missing, request a list and copies rather than assuming a liability date. Challenging a customs decision and objecting to a bankruptcy claim serve different purposes; check the route and deadline for each. A reconciliation letter does not replace a proper appeal or extend its deadline.

🧮 Illustrative reconciliation and working request

Assume the records show RUB 300,000 duty and RUB 600,000 import VAT. Principal is 300,000 + 600,000 = RUB 900,000. If RUB 200,000 has already been credited specifically against that principal, the balance is 900,000 − 200,000 = RUB 700,000. Separately claimed RUB 50,000 late-payment charges produce a total balance of RUB 750,000 but do not become principal.

The figures are illustrative, not a duty or VAT rate calculation or a test of the conditions for opening bankruptcy. Establish each item’s status, whether crediting is valid and how late charges were calculated.

Request for a customs debt breakdown

“In case No. …, the calculation shows debt under declaration No. … . Please provide a payment-type breakdown, the basis and date each liability arose, adjustment records, payments and credits. Please explain why amount … is treated as current/registered given the court’s acceptance of the application on … . According to the available documents, payment … of … relates to …; supporting evidence is attached.”

State your status and known facts. A court filing separately requires the relief sought, admissible evidence and service on participants.

Frequently asked questions

Is every customs debt paid first?

No. Current or registered status, composition and statutory priority matter. The authority’s name alone does not create universal priority.

A notice arrived after the case began. Is the debt current?

That alone is insufficient. Establish when the liability arose and its basis under the particular customs procedure.

Can duty, late charges and a broker’s fee be combined?

Keep separate review items: public payments, sanctions and contractual services have different legal bases and may have different status.

Does current status guarantee full payment?

No. It does not remove a shortage of funds or priority rules. Establish the debt and its place in distributions first.
