Rotational work during personal bankruptcy: wages, allowances and travel

One employer transfer can contain wages, allowances and travel reimbursements with different rules.

Working on a rotational assignment does not mean that you may keep every payment from your employer—or that the whole transfer must go to creditors. One transfer may include wages, an allowance paid instead of daily subsistence expenses, pay for travel days and reimbursement of costs. Separate them using the payslip and the employer’s records.

This article concerns an employee’s personal bankruptcy under Russian law, primarily the asset-realisation stage. It does not concern the employer’s bankruptcy. The rules governing access to accounts differ at other stages: a lawful employment payment does not, by itself, authorise you to spend it during the proceedings.

One transfer can contain different payments.

The bank statement alone may not identify which part reimburses expenses and which part is earnings.

Not every allowance has the same purpose.

A northern wage supplement is not the rotational-work allowance paid instead of daily subsistence expenses.

The route matters.

Transport from the assembly point to the worksite and travel from home to the assembly point have different rules.

Can the rotational allowance be retained?

Article 302 of the Russian Labour Code provides for a specific allowance replacing daily subsistence expenses for time at the rotational worksite and qualifying travel days. Its compensatory purpose matters; the word “allowance” on a payslip is not enough. The legal basis should be assessed against Article 101(1)(8)(a) of Law No. 229-FZ, which protects specified employment-related compensation, including payments connected with assignment to work in another locality.

In practical terms, identify the particular payment you seek to retain and support it with documents. Do not extend this argument to all wages, the regional coefficient or the northern wage supplement. Nor should protection be based solely on the absence of personal income tax: tax treatment and the bankruptcy estate are separate issues.

During asset realisation, Article 213.25 of Law No. 127-FZ governs the estate and statutory exclusions; the recipient does not decide these by themselves. Paragraph 1 of Supreme Court Plenum Resolution No. 48 of 25 December 2018 explains that the financial manager initially deals with the statutory exclusion of property and protected payments. Disagreements are resolved by the arbitrazh court hearing the bankruptcy case. Disclose the disputed amount and obtain the manager’s written position. Withdrawing it yourself or sending it to a relative’s card does not replace this process.

Why ticket costs and travel-day pay are different

Article 302 distinguishes daily-rate pay for specified travel days from transport funded by the employer. If the employer pays directly for the bus to the worksite, its price is not a separate cash payment to you. If you buy a ticket and later receive reimbursement, keep records linking that expenditure to the incoming payment.

For the journey from home to the employer or assembly point, the law allows reimbursement on terms set by the relevant contract or local policy. It does not make every personal flight unconditionally payable by the employer. Before buying a ticket, establish the route, supporting documents, reimbursement amount and the payment arrangements applicable in your bankruptcy proceedings.

Four steps before your next assignment

  1. Request an itemised calculation. The employer’s statement should link each amount to its period, legal basis and bank transfer. Ask for the allowance replacing daily subsistence expenses and travel-day pay to be shown separately.
  2. Collect the route and schedule records. Include the contract, rotational-work policy, schedule, tickets and proof of actual costs. A statement showing only the total transfer is insufficient.
  3. Contact the financial manager in advance. Give the expected payment dates and separately ask how protected compensation and living expenses will be made available. If a ticket must be purchased before reimbursement, raise that funding issue before travelling.
  4. Reconcile the actual payment. Compare the payslip with the bank statement and retain the manager’s response. If there is a refusal, ask which component is disputed and why, so that a specific disagreement can be presented to the court.

Example: one transfer, several legal grounds

This is an illustrative example, not a court case. An employer transfers RUB 150,000: RUB 100,000 in earnings, RUB 30,000 as a rotational allowance, RUB 8,000 for travel days and RUB 12,000 as ticket reimbursement. That breakdown does not automatically make RUB 50,000 available for unrestricted spending.

The legal grounds for the RUB 30,000 and RUB 12,000 amounts need supporting documents. Travel-day pay must not be relabelled as ticket reimbursement. The amount available for the debtor’s living expenses is determined separately in light of the case. These numbers demonstrate a checking method, not a calculation of disposable funds.

Frequently asked questions

Are all allowances paid to rotational workers protected?

No. A northern wage supplement and the allowance replacing daily subsistence expenses are different payments. Obtain a breakdown showing the type and legal basis of each component. A similar label on a bank statement does not remove this distinction.

If several months are paid together, can I multiply the subsistence minimum?

Do not independently multiply the amount and withdraw it. Prepare a month-by-month breakdown of accruals and living expenses already received. The payment arrangement needs to be determined in your case without double counting protected amounts.

Can the employer send the money to my spouse’s card?

That does not make the income someone else’s or remove the duty to disclose it. It can complicate proof of ownership and payment tracing. Establish a lawful arrangement with the employer and financial manager instead of using another person’s account to bypass restrictions.

Can I work a rotation if the court hearing is in another city?

Your work schedule does not replace procedural obligations. Arrange to receive documents and communicate with your representative, and check the court’s participation requirements for the particular hearing. A rotational assignment does not automatically postpone the case or release the debtor from their duties.
