Deposit at Russian Bankruptcy Auctions: Refund and Credit

Short answerAn auction deposit secures a genuine bid. Deposits are refunded to all bidders other than the winner within five business days after the results protocol is signed. The winner’s deposit is credited toward the price and may be retained if the winner fails to sign or pay, subject to the statute, sale notice and deposit agreement.
01

Read the sale terms

The EFRSB notice and deposit agreement control the amount, deadline, account and payment details.

02

Five business days

This is the statutory refund period for bidders who did not win.

03

The winner pays the balance

The deposit is part of the price, while contract and final-payment deadlines remain separate.

How the deposit works

Article 110 of the Bankruptcy Law requires the sale notice to state the deposit amount, timing and payment procedure. The organiser also publishes the digitally signed deposit agreement. Funds must arrive in time and be identifiable with the bidder and lot.

FAQ

Can the deposit be sent on the last day?

That is risky because timely receipt under the stated procedure matters.

Is the second bidder refunded?

Yes, unless that bidder becomes the winner or a specific lawful retention ground applies.

Can interest be claimed for delay?

Potentially, but default, liable party and the calculation must be established separately.

Can forfeiture be challenged?

Yes where notice, deadlines, alleged default or sale terms are disputed; the documents control the result.
