Driving Licence Disqualification in Russia: Defence and Appeal

A driving-disqualification case should be handled from the first procedural document. The result depends on the alleged offence, the evidence, the rights explained to the driver, procedural deadlines and the individual circumstances that the authority or court must assess.

Do not ignore the protocol or notice

Check the date, place, alleged event, legal provision, witnesses, explanations and attached materials. The administrative-offence protocol must contain the information required by the Code. If the account is inaccurate or incomplete, written explanations and requests to add evidence should be made in the proper procedural form.

Gather evidence early

  • the protocol, ruling, notices and proof of service;
  • dashcam video, CCTV records, photographs and location data;
  • witness details and written explanations;
  • medical or technical documents where relevant;
  • documents confirming individual circumstances relevant to the case.

Participation and appeal

The person subject to administrative proceedings has procedural rights, including the right to examine materials, give explanations, submit evidence and use legal assistance. A ruling that has not entered into force is generally appealed within ten days from delivery or receipt of its copy, subject to the specific statutory rules and possible restoration of a missed deadline.

What legal review can do

Legal review checks whether the alleged elements of the offence are proved, whether evidence is admissible and reliable, whether the procedure was observed and whether any defence or mitigating facts apply. It cannot promise a particular result.

Legal framework

Key provisions include Articles 25.1, 28.2 and 30.3 of the Russian Code of Administrative Offences. This material is general information, not advice on an individual driving case.
