A Russian bank safe-deposit box does not protect cash or valuables inside it from personal bankruptcy. The debtor must disclose the agreement, location and contents; legal treatment depends on ownership, source and the bankruptcy estate.
| Item | Evidence | Reason |
|---|---|---|
| Agreement | Bank, agreement number, term, fee and custody model | Determines access and bank documentation |
| Authorised persons | Key, card, power of attorney and shared access | Shows practical control |
| Cash | Amount, currency and source | Reconciles inventory and account movements |
| Jewellery and objects | Description, quantity, value and purchase records | Determines owner and treatment |
| Documents | Nature of documents and independent value | Not every document is a saleable asset |
| Third-party property | Custody, purchase and transfer records | Possession does not automatically prove title |
Why the bank may not know the contents
Under the no-liability model, the client places and removes valuables while the bank controls access to the room. Lack of a bank inventory does not prove an empty box. The debtor still must disclose composition and location under Article 213.9.
Safe-deposit box records
Mark the information ready for disclosure.
How to preserve evidence
Do not remove secretly
Do not empty the box after the procedure starts outside manager control.
Disclose details
Provide precise bank, agreement, term and access information.
Describe contents
Separate debtor assets, documents and third-party objects.
Coordinate access
Agree the date, participants and recording method with bank and manager.
Prepare an act
Record contents, condition, quantity, currency and accompanying records.
Classify treatment
Determine estate status, statutory immunity and third-party ownership separately.
Keep copies
Retain the act, photographs, correspondence and bank records.
Frequently asked questions
Will the manager discover the box?
The manager has statutory information powers, while the debtor must disclose asset location.
May it be omitted if the bank does not know the contents?
No. The Civil Code custody model does not remove the debtor’s disclosure duty.
Will title documents stored inside be sold?
Title documents normally evidence another asset rather than replacing it. Disclose the document and classify the underlying asset.
What if the cash belongs to a relative?
It is not automatically estate property, but oral family explanations are insufficient. Evidence of source, title and custody is needed.
Who attends opening?
The agreement, procedure and manager position matter. Coordinate participants and a written act in advance.
