Russian Business Centre Bankruptcy: Leases, Assets and Payments

In a Russian business centre bankruptcy, identify the debtor first: the building owner, landlord, facility operator and payment recipient may be different legal persons. Opening insolvency proceedings does not automatically terminate every lease. Review title, mortgage, lease terms, security deposit, utilities, tenant access, property inside the premises and decisions on continued operation or building sale.

Identify the Debtor and Building Owner

Compare property records, contract, invoices, handover acts and payment details. An owner may delegate leasing or operation to another company without transferring title. Direct each claim to the person that assumed the relevant obligation.

The name on the facade does not identify the debtor. Contract details and payment trail are decisive.

The Lease After Proceedings Begin

Opening a case does not itself cancel a lease. Review term, registration where required, arrears, current payments, termination grounds and actual occupation. Access restrictions require a contract- and fact-specific assessment rather than a general bankruptcy notice.

Deposits, Utilities and Service Charges

A security deposit has separate set-off and return conditions. Utility advances, variable rent and operating charges require separate calculations. Establish the relevant period, due date and actual consumption for each amount.

Tenant Property and Centre Equipment

Tenant furniture, stock, servers and records do not become debtor property because they remain in the building. Lifts, engineering systems, access controls and other equipment may form part of the property, belong to the operator or be leased.
