Cargo delivered to a Russian freight forwarder does not become its property or enter its bankruptcy estate merely because the debtor controls it. Identify the cargo location, actual carrier or warehouse, money received and obligation breached. A freight forwarder and carrier are not interchangeable roles.
Separate the cargo
Customer title requires identification through transport records, markings and storage.
Map the chain
A forwarder may engage carriers, terminals, warehouses and customs representatives.
Documents define the dispute
Instructions, forwarding receipts and transport records connect route and responsibility.
Quick self-check
- Contract and a specific forwarding instruction are available.
- Waybills, receipts, applications and cargo markings are collected.
- Actual carrier and storage location are known.
- Customer funds and contractor payments are reconciled.
- Loss, shortage, damage or delay is documented.
Locate Cargo and Participants
Immediately request route, vehicle, warehouse, terminal and the actual custodian’s details. For identifiable cargo, notify them of title and request exclusion from debtor property.
Forwarder or Carrier
A forwarder organises agreed services and may engage third parties. A carrier undertakes delivery. One entity may combine roles, but liability is reviewed for each event and record.
Money Flow
Customer payment may include forwarding fees, freight, terminal and customs expenses. Determine which amounts reached contractors and which remained with the debtor. Unperformed service and unremitted money are separate calculation elements.
Loss, Damage and Delay
Prepare a commercial or equivalent condition record, preserve photos, seals, weight, correspondence and demand. Claim value depends on proven value, breach, responsible participant and insurance already recovered.
- record event and date;
- identify route segment;
- name responsible person;
- calculate uncovered loss;
- follow demand and insolvency procedure.
Registered and Current Claims
Pre-petition services generally lead to registered claims; post-petition services may be current payments. The 2025 information and operating amendments do not remove the need for primary records and period separation.
