Bankruptcy of a Russian Road Transport Company: Cargo and Claims

Customer cargo does not become the property of a bankrupt Russian road carrier merely because it is inside the carrier’s vehicle or warehouse. Document the Cargo and Custody Chain

Under a carriage contract, the carrier receives cargo entrusted by the consignor for delivery to the consignee. Possession for performance does not transfer ownership. Preserve the waybill, order, loading and unloading records, warehouse records, seals, photographs and GPS data.

If the cargo still exists, identification, preservation and delivery to the entitled party usually come before replacing the proprietary issue with a damages calculation.

Separate Cargo from the Debtor’s Estate

The estate contains debtor-owned property. Third-party cargo accepted for carriage or custody requires separate identification and title evidence. The same site may contain carrier stock, customer property, pallets, containers and rented assets.

Vehicles, Leases and Security

Debtor-owned trucks and trailers may enter the estate. Leased and rented vehicles remain connected to owner rights and contract terms; secured vehicles are sold under secured-creditor rules. Registration and possession must be read together with the contract and title transfer.

Loss, Damage and Delay

The carrier is responsible for cargo custody under civil and transport rules, subject to statutory defences. Separate lost or damaged cargo value, carriage charge and other evidenced losses. Road-carriage disputes require a transport demand before litigation.
