Unable to Pay a Loan in Russia? A Step-by-Step Plan

In brief: what to do if you cannot repay a loan in Russia

Do not disappear from the lender and do not cover an old debt with an expensive new loan without a repayment plan. First determine whether the problem is temporary, request a full debt statement and make a written proposal: statutory payment holidays, restructuring or a revised schedule. If repayment cannot realistically be restored, assess litigation risks and personal bankruptcy before arrears escalate.

Immediate steps before missing a payment

Russian statutory payment holidays in 2026

A permanent payment-holiday mechanism for consumer loans has applied since 1 January 2024. A borrower may generally qualify where income for the two months before applying fell by more than 30% compared with average monthly income in the preceding 12 months, or where the borrower was affected by an emergency. The relief period may last up to six months.

Eligibility also depends on the type and original amount of the loan, supporting documents and other statutory conditions. According to the Bank of Russia, the current limits are RUB 1.6 million for car loans, RUB 450,000 for other consumer loans and RUB 150,000 for credit cards. Mortgages are governed by a separate regime.

A holiday does not cancel the debt. Interest continues to accrue as prescribed by law and the repayment term will normally be extended. If the lender refuses, request a reasoned response and review its calculation and grounds.

Restructuring versus refinancing

Restructuring changes the existing agreement with the current lender. The lender may reduce the monthly payment by extending the term, move the payment date or offer its own relief period. Unless statutory holiday conditions are satisfied, this is generally a matter for the lender.

Refinancing means taking a new loan to repay existing liabilities. It is useful only where the total cost is lower and associated expenses remain reasonable. Attractive refinancing usually becomes harder after arrears arise.

Before signing, compare not only the monthly payment but all future payments, insurance, fees, security and early repayment terms.

If arrears have already arisen

Ask the lender for a current breakdown of principal, interest, penalties and other charges. Keep communications in writing and retain payment evidence. A partial payment does not by itself suspend enforcement unless a revised arrangement is agreed.

Do not ignore court mail. A claim may proceed through a court order or ordinary proceedings and, once an enforceable document is issued, through bailiffs. The available response and deadline depend on the document, so record the date of receipt.

When to consider personal bankruptcy

Bankruptcy is not an automatic “loan write-off”. It is a statutory process involving review of assets, income, transactions and the debtor’s conduct. It may need to be assessed where the payment difficulty is permanent, there are several debts and no affordable schedule is realistic.

Out-of-court bankruptcy through a Russian multifunctional centre (MFC) is available where qualifying debts total between RUB 25,000 and RUB 1 million and one of the statutory gateway conditions is met. Court bankruptcy covers other circumstances. Some liabilities survive bankruptcy, and dishonest conduct may prevent a discharge.

  • income evidence and documents explaining its reduction;
  • details of other loans, guarantees and enforcement proceedings;
  • a list of assets and significant transactions in recent years;
  • communications with the lender, collectors and any court documents.

Frequently asked questions

Can I simply stop paying?

Missing payments does not remove the obligation. Contractual and statutory charges may accrue, the credit history may deteriorate and the lender may sue. A written restructuring proposal before default is usually safer.

Must the lender grant restructuring?

A lender’s own restructuring programme is generally discretionary. Statutory consumer or mortgage holidays are different: a refusal may be reviewed where every legal condition is satisfied.

Do payment holidays damage the credit history?

The holiday is recorded, but use of a statutory relief period is not itself a breach. Arrears outside the agreed period are recorded separately.

Should I take a new loan to pay an old one?

Only where this is genuine refinancing with a lower total cost and an affordable payment. An expensive loan without a sustainable source of repayment usually makes the problem worse.

Can the lender take my only home?

The general protection for a sole suitable home has exceptions. Mortgage property is subject to special rules. The answer depends on security, enforcement and any bankruptcy proceedings.

Is free bankruptcy available?

Out-of-court bankruptcy through an MFC does not require court proceedings or payment of a financial manager, but it is limited to the statutory debt range and gateway conditions. Court bankruptcy involves mandatory costs.

What if I have received a Russian court order?

Record the date of receipt and immediately check the deadline and grounds for objections. If ignored, the order may become enforceable.
