Inherited Loans and Debts in Russia: A Guide for Heirs

A loan does not automatically disappear when the borrower dies.

An heir who accepts the inheritance may inherit property debts, but liability is limited to the value of the inherited property received.

Which debts may pass to heirs?

Transferable property obligations may include bank loans, private loans, contractual debts, taxes, and utility arrears.

Obligations inseparably connected with the deceased’s personality do not pass. Each claim therefore requires legal verification.

Liability limit

Heirs who accept the inheritance are jointly and severally liable for the deceased’s debts.

Each heir remains liable only up to the value of the inherited property received by that heir.

Important: an heir cannot accept an apartment, account, or vehicle while rejecting only the loan.

A checklist before acceptance

  1. Open the inheritance file. Ask the notary about known assets.
  2. Identify debts. Review contracts, bank notices, enforcement records, liens, and guarantees.
  3. Request calculations. Ask creditors for the legal basis, principal, interest, and penalties.
  4. Check insurance. The death must qualify under the actual policy.
  5. Value the assets. Compare realistic asset value with verified liabilities.
  6. Choose. Accept, refuse, or prepare a dispute with the creditor.

Loan insurance

Insurance does not guarantee automatic repayment. Check the insurer, policy term, insured risk, exclusions, notice rules, and required documents.

Notify both the bank and insurer, but do not admit an unverified debt calculation.

Refusing the inheritance

An heir may refuse within the period allowed for acceptance. The general period is six months from the opening of the inheritance.

Special timing rules may apply in particular cases.

Refusal is filed with the notary at the place where the inheritance was opened. It cannot later be changed or withdrawn.

A minor or legally incapable heir requires prior guardianship approval.

If the bank demands payment

  • do not pay solely on a telephone demand;
  • request the agreement, calculation, and evidence of any assignment;
  • report the borrower’s death and the inheritance-file details;
  • do not sign a debt acknowledgment before review;
  • preserve evidence of inherited value;
  • raise defenses on the debt, limitation period, and liability cap in court.

Before acceptance, a creditor may sue the inherited estate. The executor or notary may be involved.

The limitation period does not restart merely because the debtor died.

Mortgage, car loan, and guarantees

Collateral survives the borrower’s death. Review the claim amount, collateral value, agreement, and insurance before deciding.

Guarantees require separate analysis. Their consequences depend on the contract and applicable rules.

Common mistakes

  • accepting without checking creditors and liens;
  • relying on an oral promise that the bank will write off the loan;
  • missing the refusal period;
  • paying more than the inherited-value cap;
  • ignoring insurance and interest calculations;
  • overlooking acts that may amount to factual acceptance.
