Apartment Gift Agreement in Russia: Key Steps

A gift of an apartment in Russia is a transfer without payment. It should not be used as a substitute for a sale, a loan or an informal promise. Before signing, the parties need to identify the property, check the ownership position and understand the required notarial and registration steps.

Short answer. For a gift of real estate between individuals, the agreement must be notarised. The transfer of ownership also requires state registration. A signed document alone does not answer every question about ownership, existing rights or the validity of the transaction.

What a gift agreement records

Under Article 572 of the Civil Code, a gift is a gratuitous transfer of property or of a property right. If the arrangement includes a counter-payment or another reciprocal obligation, it is not automatically treated as a gift. The document should identify the donor, the recipient and the apartment or share being transferred, and should reflect the parties’ actual arrangement.

Form and notarial certification

Article 574 of the Civil Code requires notarisation for an agreement for the gift of real estate between citizens. The notary examines the submitted documents and completes the notarial act within the applicable procedure. The parties should clarify the required document package and appointment arrangements directly with the chosen notary.

State registration of the transfer

Notarial certification and state registration are separate steps. The registration authority records the transfer of the registered right. Before the transaction, check the current entry in the Unified State Register of Real Estate and any restrictions, mortgages, arrests or other registered rights that may affect the transaction.

Situations requiring additional care

  • Shared ownership. Determine exactly which share is being transferred and whether the transaction involves other owners or registered rights.
  • Residence and use. A gift agreement should not conceal an unresolved question about a person’s right to live in the apartment.
  • Future promises. A promise to give property later has separate legal requirements and must identify the intended gift and recipient.
  • Inheritance. A provision that transfers a gift only after the donor’s death is not a valid gift agreement; inheritance rules apply instead.

Can a completed gift be reversed?

There is no universal right to reverse a completed gift simply because circumstances changed. The Civil Code contains specific rules on refusal and cancellation, and the facts of a particular transaction matter. Do not rely on a verbal understanding as a substitute for reviewing the documents and the legal basis.

Gift before insolvency

A gift made when a person is already facing insolvency or creditor claims may raise separate bankruptcy issues. That question is different from the ordinary form of a gift agreement and requires its own evidence-based assessment.
