💳 Standard fees for a challenge
Tax Code Article 333.21(1)(19)–(21) sets the following rates for Russian arbitrazh proceedings. These amounts exclude any applicable exemption or relief granted by the court.
| Filing | Individual | Organization |
|---|---|---|
| Appeal | RUB 10 000 | RUB 30 000 |
| Cassation to an arbitrazh district court | RUB 20 000 | RUB 50 000 |
| Cassation or supervisory challenge to the Supreme Court | RUB 30 000 | RUB 80 000 |
Cassation against a judicial order is specifically charged under subparagraph 19. Do not choose its rate merely because a document is called cassation. A challenge to a Supreme Court judge’s refusal to transfer a complaint is assessed under subparagraph 21.
⚖️ Why simply halving the fee is wrong
The 50% rule in subparagraph 9 concerns applications, claims and separate bankruptcy disputes according to their substance. Appeals and cassation have their own rates. Do not carry the fee for the original filing over to the next court level.
Hypothetical example: a company files an appeal without an exemption. The standard fee is RUB 30 000; halving it again to RUB 15 000 solely because the case concerns bankruptcy is incorrect. For an individual on the same assumptions, the standard fee is RUB 10 000. These are payment examples, not a forecast of total litigation expenses.

🔎 Review exemptions for the particular filing
Distinguish a statutory exemption for a category of person from relief granted because of financial circumstances. Their grounds and scope differ. An exemption for a first-instance filing may not extend to an appeal.
The Supreme Court explains that a creditor challenging refusal to admit a register claim or its lower ranking does not avoid the appeal fee merely because the register application was exempt. Where first instance granted financial relief, a fresh supported motion may be made for the appeal. A company’s bankruptcy status alone does not establish inability to pay.
📁 Payment and filing checklist
- Record the case number, act date, dispute and court level. Check the appeal route and deadline separately from the fee.
- Identify the applicant and its status. A representative does not substitute their own rate for the applicant’s.
- Check the precise exemption and its scope at this court level.
- Obtain payment details from the relevant court’s official website. Do not use the procedure’s deposit account for a budget payment.
- Attach evidence of an executed payment, exemption documents or a supported relief motion.
- Keep the filing inventory and submission confirmation. If the court leaves the appeal without movement, check its specific objection and correction deadline.
Other appeal attachments, including the challenged act, service evidence, authority and required representative qualifications, must be checked under procedural law. A receipt does not replace them.
📝 When funds are insufficient
Specify whether you seek exemption, reduction, deferral or instalments. Explain the present financial circumstances and attach evidence. A company should reconcile all accounts, balances, cash movements, restrictions and near-term mandatory payments relevant to its inability to pay. An individual should document income, accounts, assets and necessary expenses supporting the request.
Working structure of a relief motion
“Together with the appeal in case No. ___, I request ___ concerning the RUB ___ court fee. Full payment on the filing date is not possible because ___. Supporting documents: ___. For deferral or instalments, the proposed date or schedule is ___.”
This is a hypothetical structure, not a promise of relief. Choose a coherent request or justified primary and alternative requests; do not retain every option mechanically.
Submit the motion with the appeal. An old first-instance motion and outdated bank statements alone do not prove the position on the new filing date.
Frequently asked questions
Does bankruptcy make every appeal free?
No. The filing type, applicant and exact exemption must be checked.
Does the representative determine the rate?
The applicant and filing determine it. Representation alone does not change the rate.
First instance granted financial relief. Is a new motion needed?
For relief based on financial circumstances, provide a new supported request with current documents. Check the scope of any statutory exemption separately.
Can a mistaken fee payment be treated as the procedure deposit?
These payments have different purposes and details. Review the actual payment; one type cannot automatically substitute for the other.
