A Russian court order for credit debt is issued without a hearing or the parties being called. If the debtor disagrees with enforcement, the first steps are to check when the copy was received and submit objections to the same justice of the peace. Cancellation does not extinguish the underlying debt: the creditor may still bring an ordinary claim.
Check these points first
- Which court issued the order. The case number and court district appear in the order and notice.
- When the copy was received. A ten-day period for objections is connected with receipt of the court order.
- What is claimed. Compare the creditor, principal, interest, penalty and costs with the agreement and payment records.
- Whether enforcement has started. An order may be submitted for enforcement; that does not itself remove procedural remedies.
How to proceed
File written objections to enforcement with the court that issued the order and keep proof of submission. Where the period has been missed, the objections should explain why timely filing was impossible for reasons beyond the debtor’s control. The court assesses those circumstances individually.
What cancellation means
After cancellation, the creditor may pursue the same claim in ordinary proceedings. Both sides may then file evidence and substantive objections. Cancellation is a procedural step, not a promise of a payment holiday, debt discharge or outcome in later litigation.
