Court debt recovery in Russia is used when a debtor does not pay voluntarily and the creditor can prove the obligation and default. Before filing, the creditor should identify the correct court and procedure, calculate the claim, comply with any mandatory pre-action process, and preserve admissible evidence.
Key point: the existence of an unpaid invoice or agreement does not guarantee recovery. The court examines the legal basis, performance by the creditor, maturity, calculation, limitation period, and procedural compliance.
Initial legal review
The creditor should verify the debtor’s identity and status, the source of the obligation, the date of default, and the applicable limitation period. If a pre-action demand is mandatory under law or contract, proof of dispatch and expiry of the relevant period should be filed with the claim.
Court order or ordinary claim?
Court order procedure
This simplified route is available only for claims specifically listed by law and supported by documents. The order is issued without a hearing. A debtor may submit timely objections, after which the creditor may need to proceed with an ordinary claim.
Claim proceedings
Ordinary proceedings are used where there is a dispute about rights, the claim is not eligible for an order, an order has been cancelled, or evidence and objections require examination.

Which court has jurisdiction?
Commercial disputes between legal entities and individual entrepreneurs are generally heard by Russian arbitrazh courts. Disputes involving individuals outside business activity are generally heard by courts of general jurisdiction. Territorial venue normally follows the defendant’s address, subject to statutory and contractual exceptions.
Evidence commonly required
- the contract, loan receipt, act, or other source of the obligation;
- proof that money, goods, works, or services were provided;
- invoices, acceptance documents, payment records, and correspondence;
- a transparent calculation of principal, interest, and penalties;
- the pre-action demand and proof of dispatch where required;
- proof that copies were sent to other parties;
- documents confirming representation authority.
What may be recovered?
Depending on the legal basis, a creditor may claim principal, contractual or statutory interest, penalties, interest for the use of another person’s funds, and litigation expenses. Each component requires a legal basis and a clear calculation. A court may reduce a manifestly disproportionate penalty, while representative costs are assessed for reasonableness and must be proved.
After the judgment
A judgment does not itself transfer money. After it becomes enforceable, the creditor receives an enforcement writ or uses a court order that also serves as an enforcement document. Depending on the available information, it may be presented to a bank, an employer, or the Federal Bailiff Service. Active monitoring of enforcement is often as important as winning the case.
Common mistakes
- missing the limitation period;
- filing in the wrong court or against the wrong defendant;
- omitting a mandatory pre-action demand;
- using an unsupported or mathematically incorrect calculation;
- requesting a court order despite an obvious dispute about rights;
- failing to prove dispatch of documents;
- remaining passive after obtaining the enforcement document.
