Appealing a Russian bankruptcy judgment: deadlines, grounds and documents

A judgment declaring a debtor bankrupt can be appealed where the applicant has standing and legal grounds. The general appeal period for a judgment is one month. Filing alone does not stay enforcement: a stay requires separate consideration. Start with the full judgment, its date and the specific alleged judicial error.

First identify the judicial act

Many different acts are issued in one bankruptcy case. For a company, a judgment declares bankruptcy and opens liquidation proceedings. For an individual, a judgment declares bankruptcy and introduces asset realisation. Neither is the same as admission of a petition, introduction of debt restructuring or completion of the procedure.

Who can appeal a declaration of bankruptcy?

Article 257 of the Commercial Procedure Code grants appeal rights to case participants and other persons in the situations provided by the Code. Bankruptcy also requires assessment of procedural status under Law No. 127-FZ. A debtor or creditor should identify its status, the affected right and the connection to the challenged act, rather than merely describing an economic interest.

A non-participant must explain how the judgment directly affects its rights or obligations. Paragraph 2 of Supreme Court Plenum Resolution No. 12 of 30 June 2020 requires this justification. A relative’s, business partner’s or shareholder’s disagreement does not automatically establish standing.

If a representative acts, verify the authority to appeal and the documents establishing entitlement to represent the applicant. For a company, also determine who may sign at the current stage and in what procedural capacity. A former job title does not replace valid authority.

What is the appeal deadline?

Under Article 259(1), an appeal against a judgment is filed within one month of its adoption unless the Code provides a different period. Article 176 treats the date when the full judgment is prepared as the date of adoption. Record both dates where the operative part was announced before the reasoned text.

One month is not necessarily 30 days. Procedural calculation rules, including the end of a month and non-working days, apply. Do not rely only on the date a letter reached you or a notice appeared in the bankruptcy register. Late receipt of the act requires separate assessment of restoration of time.

If time has expired. Article 259(2) permits restoration for reasons beyond the applicant’s control. An application and evidence are needed. The law provides a six-month outer limit, with a special starting point for Article 42 applicants based on awareness of the infringement. This is not an extra six-month filing window or a guarantee of restoration.

Supply evidence of when the relevant information became known, notification problems and the objective obstacle, explaining the whole period of delay. An unsupported assertion that you “did not know” may be insufficient. If the act has already been through appeal or become final, assess the appropriate further review route instead of copying a first-appeal template.

What grounds can justify reversal?

Article 270 covers errors in establishing facts, evidential support and application of law. A procedural violation is generally assessed by its effect on the outcome; the violations listed in paragraph 4 provide unconditional grounds for reversal.

Illustrative scenario. A judgment states that a debt remains unpaid although the file contains a payment record relating to that debt. A useful argument identifies the payment’s purpose, date, recipient, location in the file and effect on the legal conditions for bankruptcy. A transfer under another contract or after a different legally relevant date does not automatically establish an error. This illustrates preparation of an argument; it is not fabricated judicial practice.

Article 268 does not allow new evidence unconditionally. The applicant must justify why it could not be produced at first instance for reasons beyond its control, and the court decides whether to admit it. An appeal should not become an unexplained attempt to assemble the entire evidential record again.

What should the appeal contain?

Under Article 257, the appeal goes to the appropriate appellate commercial court through the first-instance court that adopted the judgment. Article 260 specifies its content and attachments. A practical structure is:

  1. The court, case number, date and identification of the challenged judgment.
  2. The applicant, procedural status, other participants and representative.
  3. The findings challenged and the extent of the challenge.
  4. Each alleged error: fact, legal rule, evidence and requested correction.
  5. The requested relief, consistent with appellate powers and the circumstances.
  6. Separate applications, a list of attachments, date and signature.

Attach the judgment, evidence that the appeal and documents unavailable to other participants were sent to them, proof of the court fee or exemption or a reasoned fee application, and evidence of representative authority and status. A late appeal also needs a restoration application with supporting evidence. Check the fee for the specific applicant and type of filing; the court-fee resource can assist.

Electronic filing does not remove requirements concerning signatures, readable files, authority or service of copies. Retain the submission confirmation and monitor the order admitting the appeal or requiring defects to be corrected. Recording a submission is not the same as accepting the appeal for examination.

Does filing an appeal stop bankruptcy?

Not automatically. Article 52 of Law No. 127-FZ provides for immediate enforcement of bankruptcy judicial acts unless otherwise prescribed. An appeal and a request for a stay are therefore separate procedural actions.

Article 265.1 allows the appellate court to stay enforcement subject to statutory conditions. The application must establish that reversal of enforcement would be impossible or difficult, or provide the required security. An electronically filed stay application requires an enhanced qualified electronic signature under that article. Identify the specific act, risk and requested measure; the court decides by an order.

A stay of enforcement differs from suspension of the bankruptcy proceedings. Until the relevant order exists, the mere filing of an appeal should not be treated as a prohibition on procedural action.

An action plan that protects the deadline

  1. Obtain the full judgment. Match the case number, dates, operative part and later acts.
  2. Check standing and time. Identify the applicant, authority and last filing day.
  3. Build the grounds. Explain the legal significance of each error and supporting evidence.
  4. Prepare attachments. Address the fee, service, authority and necessary applications.
  5. File and verify admission. Monitor the case and comply with any court directions by the specified date.
  6. Address enforcement separately. Do not assume the appeal itself stops the procedure.

Frequently asked questions

Can bankruptcy be cancelled simply because I changed my mind?

Disliking its consequences does not itself establish that the judgment is unlawful. Termination and other settlement routes have separate conditions.

Does the one-month period apply to every order in the case?

No. Identify the type of act and the specific rule first. This guide concerns the judgment declaring bankruptcy.

Should I send the appeal straight to the appellate court?

It is addressed to the relevant appellate court but filed through the first-instance court under Article 257.

May documents absent from the original file be added?

The conditions for admitting additional evidence under Article 268 must be justified. Admission is not guaranteed.

Does reversal discharge every debt?

No. The new court act’s operative part determines the consequences. Reversal of a bankruptcy declaration is not the same as release from liabilities.
