An OSAGO dispute with an insurer does not usually begin with a court claim. A consumer first sends the insurer a written request or pre-trial complaint with the relevant documents. If the response does not resolve the dispute, claims within the Financial Ombudsman’s jurisdiction must be submitted there before court proceedings.
OSAGO dispute procedure
- Record the circumstances. Keep the policy, accident notice or documents from competent authorities, the insurance claim, calculations, photographs, correspondence and the insurer’s reply.
- Send a written request to the insurer. State precisely what you seek: payment, an additional payment, repair arrangements or another form of performance. Attach the supporting documents.
- Check the Financial Ombudsman route. Before a lawsuit, OSAGO disputes within the Ombudsman’s jurisdiction are considered through that procedure. The consumer applies after first approaching the insurance company.
- Assess court proceedings after the outcome. The law lists situations in which a consumer may go to court after an Ombudsman decision, when no decision is made within the statutory period, or when consideration is terminated. The time limits and the exact claim require review of the documents.
