Withdrawing bankruptcy proceedings versus withdrawing the debt claim
A creditor may initiate bankruptcy or submit a monetary claim in a case that has already commenced. In the first situation it seeks to start the procedure; in the second it asks the court to establish the components, amount and ranking of its claim. “Please withdraw my application” does not identify which result the creditor wishes to abandon.
| Creditor’s action | What the court examines | Main consequence |
|---|---|---|
| Withdrawing a bankruptcy petition before the court determines whether it is justified | The stage, other petitions and whether withdrawal is permissible | The creditor cannot commence bankruptcy again on the same grounds, but may file its debt claim in a procedure introduced on another person’s petition |
| Withdrawing an application for admission to the claims register | Intent, the signatory’s authority, legality and other persons’ rights | After acceptance, an identical claim cannot be brought again, including by an ordinary debt action |
| Reducing the amount following partial payment | The payment, remaining balance and exact procedural request | The paid portion must be addressed correctly; it does not automatically justify abandoning the entire claim |
| Removing another creditor’s established claim | Grounds for review or exclusion | This is a separate defence against an unfounded debt, not disposal of one’s own claim |
Paragraph 11 of Supreme Arbitrazh Court Plenum Resolution No. 35 links withdrawal of the initiating petition to the stage before the order determining its justification. After that order, a late withdrawal of the request to declare the debtor bankrupt is not accepted. Ending an introduced procedure requires statutory grounds. The debtor’s question about changing its mind is addressed separately in the guide to withdrawing from bankruptcy proceedings.
Can the creditor sue for the debt after withdrawal?
Article 151(3) of the Commercial Procedure Code bars repeat litigation between the same persons concerning the same subject and grounds after termination. Paragraph 17 of Supreme Court Judicial Practice Review No. 2 (2020), approved on 22 July 2020, applies this approach to withdrawal of a register claim.
In the case examined by the Supreme Court, the creditor first withdrew its application for register admission and then, after bankruptcy ended, brought an ordinary action for the same debt. The Court held that this repeat recovery attempt was impermissible. Switching the procedural form from a register application to a civil debt action does not remove the identity of the claim.
Withdrawal only of the petition commencing bankruptcy is different. Under paragraph 11 of Plenum Resolution No. 35, the creditor cannot initiate proceedings again on the same grounds, but can still submit its monetary claim if another person’s petition leads to a bankruptcy procedure. The application must identify the object of withdrawal unambiguously.
Return of papers, amendment and withdrawal are different steps
Before the court accepts an application, its return may be requested under the applicable procedural rules. After acceptance, calling a document a “recall” does not turn withdrawal into a consequence-free return of papers. The request, procedural stage and resulting judicial act determine the legal effects.
If there has been payment, a calculation error or an assignment, first establish the actual reason for changing the creditor’s position. An assignment generally raises procedural succession rather than withdrawal of the transferred claim by its seller. Where payment has been made, show the amount received, the debt it is allocated to and the outstanding balance. A payment before or during bankruptcy may itself need separate examination; the bank receipt alone does not establish that all risks have been resolved.
If another creditor’s debt is considered unfounded, use the appropriate protection mechanism. The guide to excluding a claim from the register concerns a different situation and does not replace analysis of voluntary withdrawal.
Five checks before signing
- Identify the object. Specify whether the request concerns commencement of bankruptcy, establishment of a monetary claim or part of that claim. Compare it with the original application.
- Read the judicial acts. Has the application been accepted, a procedure introduced or a claims order made? Is an appeal pending? Obtain the case materials if the available information is incomplete.
- Verify the reason. Is there actual payment, an assignment or an agreement, or only the debtor’s promise? Keep supporting documents and a reconciliation of the balance.
- Confirm authority. Article 62(2) of the Commercial Procedure Code requires a representative’s authority specifically to cover full or partial withdrawal. For a company officer, check their status and applicable corporate restrictions.
- Assess the consequences. Consider future enforcement of the same claim, other participants, costs and any illegality. The court may reject withdrawal under Article 49(5).
What the creditor’s application should contain
The following is a document review framework, not a universal instruction to terminate a dispute. It should be completed only after the appropriate procedural step has been identified.
| Section | Required information |
|---|---|
| Court and proceedings | The commercial court, bankruptcy and separate dispute numbers, debtor and creditor |
| Original application | Filing date, object, grounds and amount, together with relevant judicial acts |
| Expression of intent | Full or partial withdrawal identifying the specific claims and amounts; the remaining balance must be clear |
| Reason and consequences | The circumstances behind the decision, understanding of termination’s effects and why other persons’ rights are not infringed |
| Relief requested | A precise request concerning a specific application or part of it |
| Attachments | Authority documents, payment or other supporting records, calculation, proof of service, date and signature |
Do not include a statement that the consequences are understood as a mere formality. If the creditor expects to resume recovery when a promise is broken, an unconditional withdrawal may not achieve its objective. The settlement terms and lawful way of documenting them require separate consideration.
Does one creditor’s withdrawal end the whole bankruptcy?
Usually not. Withdrawal of one monetary claim does not represent the wishes of the remaining creditors. Article 57(1) of Law No. 127-FZ provides for termination where all participating creditors withdraw their claims, subject to the explanations in paragraph 11 of Plenum Resolution No. 35. In observation, for example, termination on that ground is possible only after the claim filing period has expired.
Where a creditor withdraws an initiating petition before its justification is examined, other pending petitions also affect the outcome: proceedings on its own petition may end while other petitions continue to be considered. The general grounds are explained in the guide to termination of a company’s bankruptcy case.
Illustrative scenario. A supplier claims principal and penalties. The debtor promises payment in a month and asks it to “simply withdraw from the register”. While no money has arrived, full withdrawal could bar another judicial attempt to recover the debt even if the promise remains unfulfilled. Before filing, compare the actual balance, settlement arrangements and the effects of the proposed step. This illustrates a risk and is not a report of an actual court case.
Frequently asked questions
Can only part of the claim be withdrawn?
Article 49 permits partial withdrawal. Precisely identify the components and amount and assess the consequences; the court still reviews whether withdrawal is permissible.
Must the court accept a signed request?
No. It will not accept withdrawal that breaches the law or another person’s rights. Genuine intent and authority are also examined.
If an admission order already exists, can the entry simply be deleted?
No. A withdrawal template cannot automatically be applied to a dispute that has already been concluded. The stage, final judicial acts and appropriate mechanism for changing the register require analysis.
Does calling the document a “recall” preserve the right to sue later?
No. The court examines its substance. If it is withdrawal of the register claim and is accepted, changing the document’s title does not remove the consequences.
Are all fees and expenses automatically refunded?
No. Applicable rules and the circumstances, including the stage and reason for withdrawal, determine this. See the separate guide to court fee refunds in bankruptcy.
