A car acquired during marriage may be divided regardless of whose name it is registered in. Relevant matters include the source of funds, purchase documents, any loan or pledge and the vehicle’s actual value.
How a car is divided
The spouses may agree who keeps it and what compensation is paid. In a dispute, the court determines common property, shares and compensation from evidence.
If the car is financed
The bank agreement, pledge and actual payments must be considered. Division does not itself change obligations owed to the lender.
