Building, movable box or cooperative right
Civil Code Article 130 distinguishes immovable and movable things. The object’s characteristics and evidence matter, rather than wall material alone. A lot can involve premises, a separate building, a movable box, a share or a cooperative-related right.
| Lot description | Establish | Insufficient by itself |
|---|---|---|
| Building or premises | Cadastral identifier, debtor’s title, address and area | Photo of numbered doors |
| Metal box | Identity, location and removal arrangements | Assurance that land ownership follows |
| Cooperative share or membership | Exact transferable right and legal basis | Membership booklet replacing full review |
| Garage and land | Each included object and right | “All registered” without documents |
The debtor’s garage guide concerns sale inclusion. This guide concerns what the buyer actually receives.
Review cooperative evidence
Request allocation documents, proof of full share payment, debtor-title evidence and cadastral records. Article 218(4) links ownership of allocated cooperative property to full share payment. An absent register entry therefore does not establish cooperative ownership without further investigation; a membership booklet alone does not prove every required fact.
If title is unregistered, establish the registration route and available evidence before bidding. An auction does not guarantee registration or cure an unauthorised structure. See the separate cooperative insolvency guide.
Check land and access separately
Identify the landowner, debtor’s use right, boundaries and legal access. For a building on another person’s land, Land Code Article 35 provides for use of the relevant land on the former owner’s terms and to the same extent. This does not mean acquiring ownership of the entire plot.
Check roads, gates, access through the cooperative, electricity and practical use. For a movable box, review its placement basis and removal cost: buying the thing does not confirm a continuing right to its location.
Inspection checklist
- Box number, address and position against plans and evidence.
- Road access, vehicle entry, doors and locks.
- Roof, leaks, cracks, floor, inspection pit and wiring.
- Actual occupier and their legal basis.
- Third-party belongings, tenants, access obstacles and vacant-possession timing.
- Keys, passes and technical documents to be delivered.
Retain an inspection record and lot-linked photographs. If inspection was unavailable, assess the uncertainty before submitting rather than assuming free repairs after payment.
📝 Handover record
Record lot and object identifiers, date and parties, condition, keys and passes, delivered documents, meter readings where relevant, remaining belongings, vacant possession and specific discrepancies. Do not accept a blanket “no complaints” statement before checking.
Deposit, payment and completion
Reconcile the notice, draft contract and evidence first. See the application guide. After the result, track contract, payment, possession and registration for real property. Analyse the former owner’s debts and your post-acquisition charges separately by legal basis; a debt certificate is not a substitute.
Hypothetical example: price RUB 500,000; credited deposit RUB 50,000; balance RUB 450,000. Repairs of RUB 70,000 and clearance of RUB 10,000 produce a RUB 580,000 budget before other applicable costs. Do not add the credited deposit again. Title and land formalities can create separate costs.
Frequently asked questions
Does a membership booklet guarantee ownership?
No. Review allocation, paid-up share, garage and land documents and other facts establishing the right.
Is delivery of keys enough?
No. Keys concern possession. Real property also requires proper evidence for registration of the transfer.
Can a purchased box always remain where it stands?
No. Placement and land access must be verified separately from ownership of the movable box.
