Public Offer in Russian Bankruptcy Auctions: Periods, Prices and Winner

↘️ A public offer uses pre-published declining-price periods. Special winner rules apply: the first application does not always win, and waiting for the next discount gives no entitlement to the lot.
01 · SchedulePeriod boundaries and minimum permitted price.
02 · ApplicationCompliant documents and a qualifying offer.
03 · ComparisonHighest price; submission time breaks a tie.

Different from an ascending auction

Article 139(4) governs transition to a public offer after repeat auctions in the specified circumstances. The notice fixes reduction amounts and periods. Without a compliant bid at or above the current period’s price, the schedule moves to the next level.

There is no universal “10% every week” rule. Download the actual current notice and approved terms. The general asset-sale guide covers the debtor’s stages; this page focuses on the buyer’s period and bid decision.

Your computer’s date alone is insufficient. Resolve unclear period boundaries or time zones before bidding. A countdown screenshot can support the evidence file but does not replace approved terms.

Competing applications: who wins?

Article 139 gives the right to the sole qualifying bidder; among different qualifying prices, the highest wins; among equal qualifying offers, the earliest timely application prevails. Compliance matters in every case, not merely the timestamp.

Hypothetical example in one RUB 900,000 period: A submits RUB 900,000 first, B later submits RUB 920,000. If both comply, B wins on price. If both offer RUB 920,000, earlier submission breaks the tie. RUB 850,000 does not qualify for this period.

Do not apply the equal-price rule against a higher offer. Nor compare bids without identifying the operative period and its closing procedure.

Set a limit and avoid double-counting the deposit

Review the asset, condition, restrictions, payment and handover first. Then fix your total budget and maximum purchase price. A lower starting price does not establish a bargain.

Hypothetical budget: a RUB 900,000 purchase price includes a RUB 90,000 deposit credited under the assumed terms; RUB 810,000 remains payable. Additional costs of RUB 70,000 give a RUB 970,000 total, not RUB 1,060,000. Do not add the credited deposit twice. The actual amount and credit treatment require the specific lot documents.

🧭 Apply now or wait?

Have documents and inspection resolved the risks? Does the current price fit your limit? Can the signature and deposit be completed in time? Can the full price be paid and the asset accepted? Waiting risks another compliant offer ending further reductions.

Keep the submission evidence

  • Current schedule and dated notice copy.
  • Application, price offer and platform registration receipt.
  • Signature and authority evidence.
  • Deposit, admission and result protocol.
  • Correspondence concerning discrepancies.

Acceptance ends when the winner is determined. Use the prescribed replacement process before closure rather than informal email; see submitting and replacing an application.

Frequently asked questions

Does the first application always win?

No. The highest qualifying price prevails where offers differ. Submission time decides between equal qualifying offers.

Will the price certainly reach the final period?

No. A compliant offer may produce a winner earlier. The schedule’s floor is not a promise to sell at that price.

Does the deposit automatically decline with the price?

Check its basis, amount and conditions in the specific notice. Do not recalculate it on an assumption.
