How to Challenge an Entry Ban to Russia

A decision not to permit entry into Russia must be assessed by its exact legal basis, the authority that issued it and the facts recorded in the relevant migration materials. A violation in another state does not by itself answer whether a Russian entry restriction was lawfully imposed; the decision and the applicable provisions of Russian law must be examined.

Start with the decision

Obtain the written decision or official information identifying the authority, date, statutory ground and duration. Entry restrictions may arise under Articles 26 or 27 of Federal Law No. 114-FZ, depending on the circumstances. The route for review differs if the issue concerns migration records, an administrative offence, security grounds or another authority’s decision.

Evidence for an application to cancel

  • a copy of the passport and migration documents;
  • the decision or reliable information confirming the basis of the restriction;
  • documents showing a change in the relevant circumstances;
  • documents supporting family, health or other legally relevant circumstances, where applicable;
  • a properly executed power of attorney if a representative applies.

Administrative review

The Ministry of Internal Affairs publishes a procedure for applying to the territorial body that made the decision, with documents supporting cancellation. The request should address the specific statutory ground rather than rely on a general statement that entry is needed.

Judicial review

If an administrative request does not resolve the matter, judicial review may be available. Time limits, jurisdiction and the necessary proof depend on the challenged act and the circumstances, so they should be checked before filing.
